HomeMy WebLinkAbout1979-038-04/17/1979-APPROVING ELECTRIC SERVICES RULES AND REGULATIONS + 3 RESOLUTION 79-38 OF THE COUNCIL OF THE CITY OF FORT COLLINS APPROVING ELECTRIC SERVICE RULES AND REGULATIONS WHEREAS, Section 112-117 of the Code of the City of Fort Collins authorizes the Director of Electric Services to promulgate appropriate rules, regulations, policies and procedures for the operation of the electric service, and WHEREAS, the City Council has received said administrative policies and procedures and desires to approve the same NOW, THEREFORE, BE IT RESOLVED BY THE COUNCIL OF THE CITY OF FORT COLLINS that the changes to the Electric Service Rules and Regulations, a copy of which is attached hereto as Exhibit "A," be, and they hereby are, accepted and approved Passed and adopted at a regular meeting of the City Council held this 17th day of April , A D 1979 or 7 ST City Clerk • s PROPOSED CHANGES TO . "ELtuTRIC SERVICE RULES AND REuuLATIONS" The Fort Collins Electric Utility request the following changes be made by resolution of the City Council in the "Electric Service Rules and Regula- tions". Changes and/or additions appear in italics Section - TERM OF SERVICE Heading - DISCONTINUANCE BY CONSUMER 1 Any customer desiring to discontinue electric service should complete and submit a "Termi- nation Order" form to the City three days prior to the desired discontinuance date The con- sumer shall be liable in any event for electric service rendered until the final meter reading is obtained Further, such notice by the consumer does not relieve him in any way from any minimums or payments guaranteed under his service contract. Heading - DISCONTINUANCE BY CITY 3 Service may be discontinued for nonpayment of past- due accounts directly or indirectly related to the provision of electric service Written notice will be given in accordance with the (TERMINATION OF SERVICE - NOTICE AND HEARING SECTION.) 6. Except where notice prior to discontinuing ser- vices is specificaZty not required by these reg- ulations, services shaZZ not be discontinued prior to the notice required by these ruZes and regu- Zattons Heading - TERMINATION OF SERVICE - NOTICE AND HEARING In cases where a notice to the customer is required before termination of service, the following pro- masons shaZZ apply 1 If any biZZ for eZectricaZ service is not paid within 25 days from the billing date, or if the City detervvanes that service shaZZ be terminated pursuant to these ruZes and regulations, the City may maiZ to the customer a Delinquency Notice, or a Notice of Intent to Terminate Such notice shaZZ be addressed to the customer at the address to which biZZs for service have been sent and shaZZ contain the foZZowing information a The number of the account. b. The amount of the unpaid biZZ, the date of the unpaid biZZ, or the other condition causing service to be terminated c. The officer of the City to be contacted to inquire about the notice and the teZephone number at which such officer can be reached. Such officer shaZZ be authorized to change any eZectrical service billing which is in error Changes to "Elect '�&ry Rules and Regs " page 2 d The date, not Less than seven days from the date the notice is maiZed, on which service will be terminated if the account is not paid, or the condition causing termination of service corrected e If an agreement on the amount due, or other reason for termination, cannot be reached with the Hearing Officer, the customer has the right to make a protest to the Utility Appeal Com- mittee by filing such protest with the Director of Finance prior to the date set forth in the not- ice when service will be terminated and the right to a hearing before such committee on any protest timely fiZed before service will be terminated f Advisement of an addztionaZ $5 00 charge if turn-off notice is delivered. 2 If the bill is not paid by the time set for termination of service, or the condition justifying termination corrected by that date, and no protest is filed with the Director of Finance, or if a protest has been fiZed, the Appeals Committee, after hearing, has not ordered otherwise, the City may deliver a turn-off notice to any person over Z8 years of age on the premises served Such notice shall contain the following a The name of the customer and the number of the account b The address of the premises served c The date and time, not Less than 24 hours after delivery of the notice, when service will be ter- minated unless the condition causing termination of service is corrected d The amount required to be paid, or the condition to be corrected, in order to avoid termination of service e The amount of additional charge that will be im- posed to reinstate service if service is termi- nated If no person is on the premises when attempt is made to deliver the turn-off notice, the notice may be Left on the premises in a conspicuous place and no further delivery of notice will be required 3 If the delinquent account is not paid, or the other condition causing termination not corrected, within the time required by the turn-off notice, the City shall terminate service to the premises Service shaZZ not be reinstated until the cause for dis- connection has been corrected and a service restor- ation fee in the amount of $Z5 00 has been paid Changes to "Elect arv. Rules & Regs." page 3 Section - SERVICE CONTRACT Heading - SERVICE DEPOSITS 1. When required. A deposit wi1Z be required from any person requesting eZectrzcaZ service to premises not owned by that person unZess said person has prevzousZy estabtished a satisfactory payment history, no turn- off notice on account of delinquency for tweZve con- secutive months, for utility services provided by the City In cases where eZectmcaZ service is provided to the owner of the property served, no deposit wiZZ be required since unpaid eZectrzcaZ charges wiZZ be a Zien upon the property to which service is deliv- ered from the date said charges become due untiZ such charges are paid. The Zzen may be enforced by the City by action at Zaw 2. Amount and form of deposit. The amount of the deposit shaZZ be two (2) times the estimated monthly biZZ for eZectrzcaZ energy to the premises served as determined by the City The deposit shaZZ be made in cash at the time the application for service is submitted to the CZty 3. Deposit application and/or return All deposits will be held by the City to guarantee payment of bills for eZectrzcaZ service. Deposits wzZZ not be considered as advance payments for service bztls but wiZZ be ap- pZzed to a customer's account when eZectrzcaZ service with the City is terminated or after eZectrzcaZ ser- vice has been received for tweZve (12) consecutive months without a turn-off notice. After termination of service, the deposit wiZZ be applied to the fznaZ biZZ and any remaining portion of the deposit wzZZ be refunded to the customer Section - METERING AND BILLING Heading - BILLING PERIOD Meter reading will be accomplished as nearly as practicable on a 30 day or monthly basis. Bills for payment become delinquent within 25 days after the bzZZzng date and the service subject to shut-off as provided under "Discontinuance by City." If the Department is unable for any reason to gain access to read any meter, the consumption shall be estimated based upon past usage. Heading - BUDGET BILLING If any szngZe family residentzaZ customer so requests, the City may estimate the average monthZy biZZ of such customer based upon the historic use of eZectrzcaZ service by that customer. Such average amount shaZZ be the monthZy bzZl rendered to the customer for eleven bzZZzng periods. In the tweZfth bzZZzng period the City wzZZ coZZect the amount the customer owes or appZy a credit to the customer's account for over-payments The monthZy budget bzZZzng amount ws1Z be adjusted for changes in the base eZectmcaZ rate Changes to "Elect -erv. Rules & Regs " page 4 Section - CONSUMER'S USE AND FACILITIES Heading - CITY ACCESS Authorized employees of the Department shall have the right of access to consumer's premises at all reasonable times for any purpose incidental to the supplying of electric service Access to the eZectrzcaZ meters must be provzded for proper bzttzng. If any meter cannot be read for three consecutzve months, the customer will be notzfzed by certzfzed mazZ that thzs condztzon must be corrected or the City wzZl discontinue service untzZ actuaZ readings can be obtained.
