OF THE COUNCIL OF THE CITY OF FORT COLLINS
AUTHORIZING THE ACOUISITION BY EMINENT DMAIN
PROCEEDINGS OF CERTAIN LANDS IN LARIMER COUNTY
WHEREAS. the City of Fort Collins desires to acquire a tract of land,
hereinafter described, for the purpose of establishing a biking, hiking,
equestrian and open space trail system, and
WHEREAS, the City has attempted to negotiate the acquisition of such
tract of land with the ot4ners of the lands, but nas been unsuccessful in
such negotiations and it appears it will be necessary to acquire sucn tract
of land through proceedings in eminent domain
NOW, THEREFORE, BE IT RESOLVED BY THE COUNCIL OF THE CITY OF FORT
COLLINS
Section 1 The City Council nereby tinds and determines tnat it is
necessary that the City of Fort Collins acquire a tract of land more

A tract of land for the purpose of a biking, hiking,
equestrian ana open space trail system along the
southerly side of the Cache la Poudre River situate in
the NE 1/4 of the SW 1/4 of Section 2 , Townsnip 7
North, Range 69 West of the 6th P M , Larimer County,
Colorado, as shot%n on the accompanying plat which is
herevith incorporated into and made a part of this
legal descrip+ion ano which is more particularly
eescribed as follo�,s
Cormencino at the West 1/4 corner of said Section 2,
thence along the north line of the SW 1/4 of said
Section 2 N 89056'C5" E 1324 19 feet to the NW corner
of the NE 1/4 SV 1/4 of said Section 2, Thence along
the test line of said NE 1/4 SV 1/4 S 0004'u6" E 940 27
feet to a point on the southerly boundary of that tract
described in BOOK 1163 , Page 554 of Larimer County
Records and to the True Point of Beginning of the
tract to be herein described, thence along said

the Point of Beginning excepting therefrom the tract
described in Book 1163, Page 554, Larimer County
Records and containing 0 7911 acres of land, more or
less,
to be used for a biking, hikino, equestrian and open space trail system
Section 2 The City Council hereby finds and determines that it is
not possible to acquire such tract of land by negotiation with the ohners
of the lands and, therefore, authorizes the City Attorney and other proper
officials of the City to acquire such tract of land for the City by eminent
domain proceedings
Passed and adopted at a regular meeting of the City Council held this
16th day of October 1979
