OF THE COUNCIL OF THE CITY OF FORT COLLINS
APPROVING THE ACCEPTANCE OF THE PROPOSED DONATION OF THE
2010 DOWNTOWN DEVELOPMENT AUTHORITY ART IN ACTION SCULPTURES
WHEREAS, in the summer of 2010, the Downtown Development Authority (DDA),
sponsored the Art in Action project(the"Project")in partnership with the City's Art in Public Places
(APP) program; and
WHEREAS, as part of the Project, the DDA commissioned the artist James Lynxwiler to .
create two bronze sculptures depicting whimsical dancers(the"Artwork"),while demonstrating the
steps for creation of the sculptures to the public in Old Town Square; and
WHEREAS, the proposed location for placement of the finished sculptures is in the City
right-of-way on the northeast corner of Linden and Walnut streets; and
WHEREAS, to accommodate this objective, the DDA wishes to donate the Artwork to the
City; and
WHEREAS, the value of the Artwork is estimated at $61,700; and
WHEREAS, as part of the donation, the DDA will agree to be responsible for the costs of
the maintenance and repair of the Artwork if necessary and appropriate; and
WHEREAS, Section 23-309 of the City Code requires that works of art with a value of$300
or more donated to the City to be placed in a public area may be accepted only with approval of the
Art in Public Places Board (the "APP Board"), and all such works with a value of$10,000 or more
may be accepted only with approval of the City Council,upon review of the proposed donation and
the recommendation of the APP Board; and
WHEREAS, at its regular meeting on October,20, 2010, the APP Board evaluated the
proposed donation of the Artwork based on the City's Art in Public Places Guidelines and
recommended that the City Council accept the donation.
NOW, THEREFORE, BE IT RESOLVED BY THE COUNCIL OF THE CITY OF FORT
COLLINS, that the City Council hereby accepts the proposed donation of the bronze sculptures
created by artist James Lynxwiler as part of the 2010 Art in Action Project.
Passed and adopted at a regular meeting of the Cou it the v of Fort Collin is 16th
day of November A.D. 2010.
