OF THE COUNCIL OF THE CITY OF FORT COLLINS APPROVING
AN AGREEMENT TO BE ENTERED INTO WITH NORTH POUDRE
IRRIGATION COMPANY
WHEREAS representatives of the City of Fort Collins have
negotiated with the North Poudre Irrigation Company for the acquisition
by the City of certain water rights and water facilities owned by North
Poudre Irrigation Company and
WHEREAS an agreement has been arrived at whereby the City
will acquire the following ditches reservoirs and water rights
Joe Wright Reservoir
The Michigan Ditch System including its priority No
319 its priority No 325 and its priority No 363
in old Water District No 47 now being renumbered
under the provisions of Senate Bill 81
and
WHEREAS the consideration for such acquisition is the transfer
to the North Poudre Irrigation Company of other water rights either now
owned or hereafter to be acquired by the City which water rights in the
opinion of the City Council are less useful to the City than those being
acquired and
WHEREAS the Water Board of The City has reviewed the proposed
exchange of water rights and the agreement for the same which has been
negotiated and has recommended to the City Council that said agreement
be entered into by the City and
WHEREAS said agreement has further been approved by the City
Manager and the City Attorney
NOW THEREFORE BE IT RESOLVED BY THE COUNCIL OF THE CITY OF
FORT COLLINS that the terms and conditions of said agreement be and the
same hereby are accepted and approved and
BE IT FURTHER RESOLVED that the Mayor and City Clerk be and
they hereby are authorized and directed to execute said agreement for
and on behalf of the City of Fort Collins
Passed and adopted at a regular meeting of the City Council held
this 18th day of February A D 1971
