HomeMy WebLinkAbout1971-045-05/20/1971-APPROVING AN AGREEMENT WITH THE JOSH AMES DITCH COMPANY RESOLUTION 71 45 OF THE COUNCIL OF THE CITY OF FORT COLLINS APPROVING AN AGREEMENT WITH THE JOSH AMES DITCH COMPANY WHEREAS it is necessary and desirable that the City of Fort Collins acquire additional raw water supply in order to provide for the anticipated growth of the City of Fort Collins and WHEREAS the Josh Ames Ditch Company has offered to convey to the City its water right being priority number 25 for 17 97 cubic feet per second of water from the Cache LaPoudre River and WHEREAS an agreement has been negotiated between the City and the Josh Ames Ditch Company for the purchase of such water right under which agreement the City would issue certificates which would be used to satisfy the City s requirements for furnishing raw water in exchange for water service on the City s system and WHEREAS in the opinion of the City Council it is desirable to acquire such water right and to enter into said agreement NOW THEREFORE BE IT RESOLVED BY THE COUNCIL OF THE CITY OF FORT COLLINS that the terms and conditions of said agreement be and the same hereby are adopted and BE IT FURTHER RESOLVED that the Mayor and the City Clerk be and they hereby are authorized and directed to execute said agreement for and on behalf of the City of Fort Collins and that the proper officials of the City are authorized to issuex certificateSln accordance with said agreement evidencing satisfaction of the requirements of the City for the furnishing of raw water supply in connection with obtaining water service from the City s system Passed and adopted at a regular meeting of the City Council held this 20th day of May 1971 ATTEST or Ci erk
