OF THE COUNCIL OF THE CITY OF FORT COLLINS SETTING
FORTH FINDINGS OF FACT AND CONCLUSIONS REGARDING THE
SPRINGS CREEK FARM ANNEXATION
WHEREAS annexation proceedings were heretofore initiated for lands
to be known as the Springs Creek Farms Annexation and
WHEREAS pursuant to resolution after notice given as requited by law
the City Council did on May 27 1971 hold a hearing on said annexation and
WHEREAS the City Council desires to set forth in writing its findings
regarding said annexation
NOW THEREFORE BE IT RESOLVED BY THE COUNCIL OF THE CITY OF FORT
COLLINS
Section 1 That the City Council hereby finds that not less than
xone-sixth ( 2/3rds)-)f the perimeter of the area involved in said annexation is
contiguous with the City of Fort Collins
Section 2 The City Council further hereby finds that a community of
interest exists between the territory proposed to be annexed and the City of
Fort Collins and the territory proposed to be annexed is urban or will be
urbanized in the near future and said territory is integrated or is capable
of being integrated with the City of Fort Collins
Section 3 That the City Council further finds that none of the pro-
visions of Section 139-21-4 Colorado Revised Statutes 1963 as amended are
violated by said annexation
Section 4 The City Council further finds that no election is re-
quired under the provisions of Section 139-21-6 (2) and no additional terms
and conditions are to be imposed in connection with this annexation
Section 5 The City Council concludes that the territory embraced
in the Spring Creek Farms Annexation is eligible for annexation to the City of
Fort Collins and should be so annexed
Passed and Adopted at a regular meeting of the City Council held
this 17th day of June A D 1971 nunc pro-tunc the 27th day of May A D
1971
