OF THE COUNCIL OF THE CITY OF FORT COLLINS CONCERNING
THE CONSTRUCTION OF A SANITARY SEWER LINE IN THE CITY
DETERMINING THE NEED TO ACQUIRE CERTAIN PROPERTY IN
THE CITY AS A RIGHT OF WAY FOR SAID SANITARY SEWER
LINE AND AUTHORIZING THE ACQUISITION OF SUCH RIGHT OF
WAY BY EMINENT DOMAIN
WHEREAS the City has heretofore initiated procedures for the for-
mation of Sanitary Sewer Improvement District No 56 for the purpose of con-
structing sanitary sewer lines to serve certain properties located in the City
and
WHEREAS in the opinion of the City Council it is necessary to
construct such sanitary sewer lines for the purpose of serving properties in
the City with sanitary sewer and
WHEREAS in connection therewith it is necessary to acquire rights
of way in which to construct such sanitary sewer lines and
WHEREAS it has not been possible to negotiate the satisfactory
agreement for the acquisition of certain necessary rights of way and it appears
that it will be necessary for the City of Fort Collins to acquire the same by
eminent domain
NOW THEREFORE BE IT RESOLVED BY THE COUNCIL OF THE CITY OF FORT
COLLINS
1 That the City Council hereby finds and determines that it is
necessary and desirable to construct a sanitary sewer line through the property
hereinafter described in order to serve the properties in the City of Fort Col-
lins with a sanitary sewer and the City Council hereby resolves to build such
sanitary sewer line
2 The City Council further finds that it is necessary in order
to construct such sanitary sewer line to acquire a right of way and easement
over and across certain property situate in the County of Larimer State of
Colorado more particularly described as follows
A temporary easement 50 foot in width to be used during
the construction of a sanitary sewer line and a 20-foot
wide permanent easement for the construction maintenance
servicing and operation and re-construction and replacement
of an underground sanitary sewer line the center line of
said easement and right of way beginning at the South-
east corner of the NE 1/4 of Section 9 Township 7
North Range 69 West of the 6th P M and running
thence North 00010 30 East 380 78 feet along the East
line of said 1/4 Section and with all bearings relative
thereto thence N 89038 00 West 165 00 feet thence
N 00010 30 East 210 00 feet to the true point of be-
ginning thence from said true point of beginning N
00010 30 East 71 46 feet to the point of termination
of said easement said point being a point on an exist-
ing 15 inch sanitary sewer line
and the City Council therefor authorizes the acquisition of such right of way
and easement by eminent domain and authorizes the City Attorney to undertake
such action as may be necessary to so acquire such right of way and easement
