HomeMy WebLinkAbout1981-072-05/05/1981-AUTHORIZING THE CITY TO ENTER INTO AN AGREEMENT WITH THE PARKWOOD PROPERTY OWNERS ASSOCIATION AND EV RESOLUTION 81-72 OF THE COUNCIL OF THE CITY OF FORT COLLINS AUTHORIZING THE CITY TO ENTER INTO AN AGREEMENT WITH THE PARKWOOD PROPERTY OWNERS ASSOCIATION AND EVERITT ENTERPRISES, INC , FOR THE PURPOSE OF UTILIZING PARKWOOD LAKE FOR THE DISCHARGE OF STORM WATER RUNOFF AND DRAINAGE AND FOR THE CONSTRUCTION OF CERTAIN IMPROVEMENTS TO SAID LAKE WHEREAS, Parkwood Lake is so located that it naturally receives storm water runoff and drainage, and WHEREAS, it is desirable that said Parkwood Lake continue to serve as a receiving facility for storm water runoff and drainage, and WHEREAS, in order to utilize said lake for said purposes, it is necessary for the City to construct certain outlet devices and sedimenta- tion structures, and, from time to time, maintain such structures, and WHEREAS, it is deemed by the Council of the City of Fort Collins to be in the best interests of the citizens that an agreement providing for the aforesaid be executed to accomplish such purposes NOW, THEREFORE, BE IT RESOLVED BY THE COUNCIL OF THE CITY OF FORT COLLINS that the City Manager be, and he hereby is, authorized and directed to enter into an agreement with the Parkwood Property Owners ' Association and Everitt Enterprises, Inc , allowing the City to direct storm water runoff and drainage into Parkwood Lake, which lake shall serve as a deten- tion facility for the "100 year storm" Said agreement shall further provide for the construction, by the City, of a sedimentation control structure and an automatic outlet device at said lake, with the cost of construction and installation of said facilities not to exceed $79,909 00 The City shall further agree to remove sediment from the sedimentation structure and shall maintain both the sedimentation structure and the outlet device All other maintenance of Parkwood Lake, including weed control , shall be the responsibility of the Parkwood Property Owners' Association Passed and adopted at a regular meeting of the City Council held this 5th day of May, 1981 9,1C'7 ATTEST Mayor �A ri-NAA�k Y\'�r rA k City C I er {
