HomeMy WebLinkAbout1983-181-10/18/1983-AUTHORIZING THE CITY MANAGER TO ENTER INTO AN INTERGOVERNMENTAL AGREEMENT BETWEEN THE CITY OF FORT C RESOLUTION 83- 181 OF THE COUNCIL OF THE CITY OF FORT COLLINS AUTHORIZING THE CITY MANAGER TO ENTER INTO AN INTERGOVERNMENTAL AGREEMENT BETWEEN THE CITY OF FORT COLLINS AND COLORADO STATE UNIVERSITY FOR THE PURPOSE OF EXCHANGING REVOCABLE PERMITS FOR THE USE OF CONDUITS, TUNNELS AND RACEWAYS WHEREAS, the City of Fort Collins ("the City") is the owner of thir- teen thousand five hundred and fifty feet (13,550' ) of a certain two inch (2") conduit, and WHEREAS, Colorado State University ( "the University") is the owner of sixteen hundred and eighty-five feet (1 ,685' ) of a certain four inch (4") conduit, tunnel and building raceway, and WHEREAS, the University desires to obtain from the City the right to use the City' s conduit for the purpose of installing and maintaining communication circuits, and WHEREAS, the City desires to obtain from the University the right to use a two inch (2") equivalent conduit within the University' s conduit, tunnels and building raceways for the purpose of gaining access to the University Computer Center, and WHEREAS, the Council of the City of Fort Collins has determined that it is in the best interests of the citizens of the City that the City and the University jointly exchange rights in the usage of the aforesaid conduits, tunnels and building raceways by means of the City granting to the University and the University granting to the City revocable permits for the usage of the various conduits, tunnels and building raceways as aforesaid NOW, THEREFORE, BE IT RESOLVED BY THE COUNCIL OF THE CITY OF FORT COLLINS that the City Manager be, and he hereby is, authorized to execute on behalf of the City of Fort Collins an Intergovernmental Agreement with Colorado State University whereby the City shall extend to the University a revocable permit pursuant to Article XIII, Section 10 of the Charter of the City for the usage of the City conduit as described in the Intergovern- mental Agreement, for the purpose of installing and maintaining a communi- cations circuit, said revocable permit to be extended to the University in exchange for the extension by the University to the City of a revocable permit for the usage of that certain University conduit, tunnel and raceway as described in the Intergovernmental Agreement for the purpose of afford- ing the City access to the University Computer Center The aforesaid exchange of revocable permits shall be made in accordance with the terms of the Intergovernmental Agreement and shall require payment by the University to the City of a net amount of Thirteen Thousand Six Hundred and Forty-Four Dollars and Seventy-Five Cents ($13,644 75) Passed and adopted at a regular meeting of the City Council held this 18th day of October, A D 1983 ayor ATTEST Mo Clty ClerK -2-
