ELIZABETH RESOLUTION 83-4 OF THE COUNCIL OF THE CITY OF FORT COLLINS MAKING FINDINGS CONCERNING THE EXPANSION OF A NON-CONFORMING USE AT 811 E ELIZABETH WHEREAS, on November 22, 1982, the Planning and Zoning Board con- sidered the enlargement of a building containing a non-conforming use, and WHEREAS, pursuant to Chapter 118-84 of the Code of the City of Fort Collins, upon considering the following criteria 1 The nature of the proposed expansion, 2 The size of the proposed expansion, 3 The difference in the degree of use of the non-conforming use as a result of the proposed expansion, 4 The reasons for the proposed expansion, 5 The overall impact of the proposed expansion on the surrounding property, the Planning and Zoning Board recommended to City Council on a 5-0 vote to deny the enlargement of a building containing a non-conforming use at 811 E Eliazbeth Street, and WHEREAS, on December 21, 1982, the Council of the City of Fort Collins concurred with the recommendation of the Planning and Zoning Board and, by a vote of 6-0, denied the requested enlargement of the non-conforming use located at 811 E Elizabeth Street, and WHEREAS, as a result of its hearing of the matter on December 21, 1982 , the Council wishes to make findings concerning the request for enlargement at 811 E Elizabeth Street NOW, THEREFORE, BE IT RESOLVED BY THE COUNCIL OF THE CITY OF FORT COLLINS that it concurs with the Planning and Zoning Board pursuant to Chapter 118-84(F) of the City Code finding that the requested enlargement would adversely affect the surrounding property BE IT FURTHER RESOLVED that upon considering the nature of the pro- posed expansion, the size of the proposed expansion, the difference in the degree of use of the non-conforming use as a result of the proposed expan- sion, the reasons for the proposed expansion, and the overall impact of the proposed expansion on the surrounding property, the City Council by a vote of 6-0 denied the request for enlargement of a building containing a non-conforming use located at 811 E Elizabeth Street Passed and adopted at a regular meeting of the City Council held this 4th day of January, A D 1983 Mayor ATTEST Ct t�erk -2-
