HomeMy WebLinkAbout2009-027-03/24/2009-AUTHORIZING THE LEASE OF CITY-OWNED PROPERTY AT 212 WEST MOUNTAIN AVENUE FOR UP TO ONE YEAR RESOLUTION 2009-027 OF THE COUNCIL OF THE CITY OF FORT COLLINS AUTHORIZING THE LEASE OF CITY-OWNED PROPERTY AT 212 WEST MOUNTAIN AVENUE FOR UP TO ONE YEAR WHEREAS, the City is the owner of real property located at 212 West Mountain Avenue, Fort Collins, Larimer County, Colorado (the "Property"); and WHEREAS, the Property was purchased as part of the Block 31 purchases and has been identified as the location of the future Performing Arts Center; and WHEREAS, the City does not have a present use for the Property; and WHEREAS, the City currently leases the Property to the Larimer Center for Mental Health(LCMH), whose lease will expire March 31, 2009; and WHEREAS, LCMH is in the process of acquiring a new facility, but may not be ready to move until June or July 2009; and WHEREAS, the City desires to continue to lease the Property to LCMH for a period of up to one year at a monthly rate of$5,187.50; and WHEREAS, when LCMH moves out, the City may seek a new tenant for the Property; and WHEREAS, the lease of the Property is beneficial in that it will generate revenue, reduce the City's costs for utilities for the Property, and also discourage vandalism of the Property; and WHEREAS, under Section 23-114 of the City Code, the City Council is authorized to lease, for a definite term of two years or less, any and all interests in real property owned in the name of the City, provided that the City Council first finds, by resolution, that the lease is in the best interests of the City. NOW, THEREFORE, BE IT RESOLVED BY THE COUNCIL OF THE CITY OF FORT COLLINS as follows: Section 1. That the City Council hereby finds that leasing the Property at 212 West Mountain Avenue for up to one year as provided herein is in the best interests of the City. Section 2. That the City Manager is hereby authorized to execute a lease agreement for the Property, consistent with the terms of this Resolution,together with such additional terms and conditions as the City Manager, in consultation with the City Attorney, deems necessary or appropriate to protect the interests of the City or to effectuate the purposes of this Resolution.
