HomeMy WebLinkAbout1981-020-02/17/1981-APPROVING CERTAIN PROPOSED RULES AND REGULATIONS OF THE LIQUOR LICENSING AUTHORITY r RESOLUTION 81-20 OF THE COUNCIL OF THE CITY OF FORT COLLINS APPROVING CERTAIN PROPOSED RULES AND REGULATIONS OF THE LIQUOR LICENSING AUTHORITY WHEREAS, on the 4th day of February, 1981 , the Liquor Licensing Authority of the City of Fort Collins reviewed and passed a Resolution establishing administrative procedures for the renewal of liquor licenses as is more particularly set forth below, and WHEREAS, Section 33-3 of the Code of the City of Fort Collins provides that all proposed rules and regulations of the Liquor Licensing Authority be presented to and approved by the City Council , and WHEREAS, all such proposed rules and regulations of the Liquor Licens- ing Authority as they relate to establishing administrative procedures for the renewal of liquor licenses have been favorably reviewed by the City Council NOW, THEREFORE, BE IT RESOLVED BY THE COUNCIL OF THE CITY OF FORT COLLINS that the Resolution of the Liquor Licensing Authority of the City of Fort Collins establishing administrative procedures for the renewal of liquor licenses as set forth in its entirety as follows, to-wit RESOLUTION OF THE LIQUOR LICENSING AUTHORITY OF THE CITY OF FORT COLLINS ESTABLISHING ADMINISTRATIVE PROCEDURES FOR THE RENEWAL OF LIQUOR LICENSES WHEREAS, Section 33-3 of the Code of the City of Fort Collins authorizes the Liquor Licensing Authority of the City of Fort Collins to promulgate rules and regulations concerning the procedures for hearings before it, and WHEREAS, Section 12-47-106, C R S , 1973, provides that a local licensing authority may require hearings on appli- cations for renewal of liquor licenses, and WHEREAS, the local licensing authority of the City of Fort Collins desires to facilitate the procedures for renewal of liquor licenses NOW, THEREFORE, BE IT RESOLVED BY THE LIQUOP LICFNSING AUTHORITY OF THE CITY OF FORT COLLINS Section 1 That upon the receipt of an application for renewal of a liquor license, the City Clerk, as secretary to the Liquor Licensing Authority, shall cause an investigation to be commenced by the Police Department of the City of Fort Collins to determine if the applicant for renewal has violated any of the ordinances of the City of Fort Collins or statutes or rules and regulations of the State of Colo- rado during the term of the license Section 2 That upon the receipt of the investigative report by the Police Department, the City Clerk may renew the license for which the application was received if no violations of the ordinances of the City of Fort Collins or the statutes or rules and regulations of the State of Colorado have been found to have been committed by the applicant during the preceding term of the license Section 3 That upon receipt of the investigative report of the Police Department, the City Clerk shall cause a hearing before the Liquor Licensing Authority to be scheduled if violations of the ordinances of the City of Fort Collins or the statutes or rules a.id regulations of the State of Colorado have been found to have been committed by the applicant during the preceding term of the license Section 4 Notwithstanding the provisions contained herein , the Liquor Licensinq Authority may, on its own motion, cause a hearing for renewal of a liquor license to be scheduled and heard by it Section 5 Notwithstanding any provision contained herein, the hearings for applications for renewal of liquor licenses shall be conducted in accordance with the laws and rules and regulations of the State of Colorado and the ordinances and rules and regulations of the City of Fort Collins Passed and adopted at a regular meeting of the Liquor Licensing AuthVity of the City of Fort Collins held this day ofQ� , A D 1981 ZTi`ai an ATTEST � &sl City Clerk -2- be, and it nereby is, approved by the Council of the City of Fort Collins Passed and adopted at a regular meeting of the Council of the City of Fort Collins held this 17th day of Feb u 1981 Mayo ________^J ATTEST City Clerk -18-
