RESOLUTION 81-21
OF THE COUNCIL OF THE CITY OF FORT COLLINS
ESTABLISHING A POLICY FOR THE ACQUISITION OF
PROPERTY FOR CITY AND COUNTY GOVERNMENTAL PURPOSES
WHEREAS, heretofore the City Council of the City of Fort Collins and
the Board of Commissioners of Larimer County have entered into an inter-
governmental agreement wherein the City and County have agreed to develop a
comprehensive master plan for future governmental facilities to be located
in the block bounded on the south by Mountain Avenue, the west by Howes
Street, the north by LaPorte Avenue, and the east by Mason Street ("Block") ,
and have further agreed to begin negotiations for acquisition of property
in the Block, and
WHEREAS, the City Council has reviewed an analysis of the different
mechanisms of acquiring property in the Block and the costs associated
therewith on the basis of this analysis and discussion thereon, the
Council has formulated a policy for such land acquisition which, in the
opinion of the Council , will achieve the goals of the above referenced
intergovernmental agreement at the least cost to the taxpayers of the City
of Fort Collins
NOW, THEREFORE, by and in consideration of the above premises, the
Council of the City of Fort Collins hereby establishes a policy for land
acquisition in the Block as follows
1 All parcels of property located in the Block will
eventually be needed for City/County governmental
purposes and therefore all parcels should be acquired by
the City and County
2 The City should be the lead agency in negotiating the
property acquisitions, but the acquisitions should be in
accordance with the duly adopted Master Facilities Plan
for joint City/County facilities and should be funded
jointly by the City and County
3 Using all appropriate legal mechanisms, the City should
immediately proceed to acquire control of all properties
in the Block, including but not limited to, the use of
lease-purchase agreements, purchase and lease-back
agreements, options to purchase and outright purchases
