HomeMy WebLinkAbout1981-041-03/17/1981-STATING THE NATURE AND LOCATION OF THE IMPROVEMENTS TO BE MADE IN THE SOUTH MASON STREET AND UTILITY r RESOLUTION 81-41 OF THE COUNCIL OF THE CITY OF FORT COLLINS STATING THE NATURE AND LOCATION OF THE IMPROVEMENTS TO BE MADE IN THE SOUTH MASON STREET AND UTILITY IMPROVEMENT DISTRICT NO 75, DESCRIBING THE AREA TO BE ASSESSED FOR THE SAME, AND DIRECTING THE DIRECTOR OF PUBLIC WORKS TO PREPARE AND PRESENT TO THE CITY COUNCIL A REPORT WHEREAS, all property owners within the boundaries of the South Mason Street and Utility Improvement District have signed petitions requesting the initiation of said District, and WHEREAS, all of said petitions waive the necessity of hearings, notices, publications, letting of bids and other procedural aspects relat- ing to the initiation or formation of said District, and WHEREAS, the City Council has reviewed said petitions and desires to continue with the formation of said South Mason Street and Utility Dis- trict NOW, THEREFORE, BE IT RESOLVED BY THE COUNCIL OF THE CITY OF FORT COLLINS Section 1 That the nature of the improvements to be made are as follows (a) Removal of organic material throughout the area to be improved (b) Installation of sanitary sewer line and water line to serve adjacent property (c) Continuation of the 18-inch storm sewer and inlet structures (d) Completion of street pavement including curb, gutter, sidewalk, basecourse and asphalt surface Section 2 The location of the improvements to be constructed are as follows (a) South Mason Street from Creger Drive to Boardwalk Drive as shown on Appendix "A" Section 3 The area to be assessed for the aforesaid improvements is the area generally bounded by Creger Drive on the nortn (and extended to the C & S Railroad right-of-way) , the west right-of-way line of South s College Avenue, the north right-of-way line of the proposed Boardwalk Drive alignment (and extended to the C & S Railroad right-of-way) , and the C & S Railroad right-of way Said property is more particularly described on Appendix "A" Section 4 The Director of Public WorKs is hereby directed to prepare and present to the Council the following (a) Preliminary plans and specifications of such improvement or improvements (b) An estimate of the probable cost of such improve- ments, including the cost of acquiring rights in land required for the improvements, the cost of planning, construction or otherwise acquiring the improvements, engineering, legal and advertising costs, interest during construction and until assessments are made by ordinance against the properties benefited, and other costs to be in- curred in the District (c) A map of the district to be assessed for the cost of the improvement or improvements Section 5 A portion of the total cost of such improvements shall be paid by the City at large and not by assessments against the property in the District Section 6 That said improvement district snall be known as the South Mason Street and Utility Improvement District No 75 Passed and adopted at a regular fleeting of the City Council held this 17th day of March, 1981 -M ayo r ATTEST ity Clerk -2-
