WHEREAS, Fort Collins, a political subdivision of the State of
Colorado, has jointly undertaken in cooperation with the United States
Corps of Engineers to provide for emergency bank protection on the
Cache LaPoudre River near the Fort Collins water treatment plant,
WHEREAS, the said City has in its own name obtained good and
sufficient title or interest in real estate by the granting of ease-
ments by the record owners as is necessary for the easements, right
of way, construction and maintenance of the bank protection as shown
on drawing number CLP1-310A1, prepared by the United States Army
Engineers entitled "Cache LaPoudre River, Fort Collins Water Treatment
Plant, Emergency Bank Protection", and
WHEREAS, the United States Army Corps of Engineers intends to
advertise for bids on said project, and it is in the public interest
and the best interest of Fort Collins, to grant the right to enter in,
over, and upon said interests and easements in said real estate to
the said Corps of Engineers, its employees, agents and contractors
for the construction of said project
NOW, THEREFORE, BE IT RESOLVED by the City Council of Fort
Collins, Colorado, that the right to enter in, over and upon the said
interests in the above described real estate as set forth above, is
hereby granted to the United States Army Corps of Engineers, its
employees, agents, and contractors for the purpose of constructing
said project, and the City Council of Fort Collins, Colorado, be and
hereby is authorized to execute the above and foregoing Resolution
and to traanit the same to the United States Aray Corps of Engineers
for the purposes set forth above
