HomeMy WebLinkAbout1978-032-04/18/1978-APPROVING BY-LAWS OF THE WATER BOARD V RESOLUTION 78-32 OF THE COUNCIL OF THE CITY OF FORT COLLINS APPROVING BY-LAWS OF THE WATER BOARD WHEREAS, the Water Board has adopted by-laws governing its operations and has submitted such by-laws to the City Council for approval; and WHEREAS, the City Council has reviewed the by-laws so submitted and finds that the same are in proper form and should be approved. NOW, THEREFORE, BE IT RESOLVED BY THE COUNCIL OF THE CITY OF FORT COLLINS that the by-laws adopted by the Water Board to govern its organization and operations be, and the same hereby are, approved. Passed and adopted at a regular meeting of the City Council held this lath day of April, A.D. 19 ATTEST: MA4jor �ep.fy City Clerk ` BY-LAWS FOR THE WATER BOARD Article I - Name Water Board Article II - Object The object of the Water Board is to be advisory to the City of Fort Collins in the following matters, 1 All matters pertaining to the acquisition, control, and disposition of water rights (Charter, IX, 7.) 2. All matters pertaining to the municipal water works system (Charter, IX, 7.) 3 All matters pertaining to sewage works. (Charter, I%, 7.) 6 All matters of concern to the City of Fort Collins with which the foregoing matters are substantially related Article III - Board Composition A. The Board consists of eleven voting members, ten members appointed by the City Council to serve four year terms without compensation and the City Manager. B. The Board shall elect by December 31 of each year a president, vice president, secretary, and such other officers as required, and it shall adopt by-laws covering its operation. C. Advisers to the Board shall be the Director of Water Utilities, staff engineers, the City Attorney, and the Board secretary Article IV - General Responsibilities A. The Water Board is advisory to the City Council. It is not policy- setting nor decision making except to the extent as authorized by the City Council. B. Attendance Policy, Openings, and Reappointments. 1. Upon acceptance of appointment, Board members are expected to attend meetings as often as they can. Any member with three consecutive absences unjustified in the opinion of the president is automatically dropped from membership. 2. The president is repponsibIL for officially notifying the City Council (with copy to City Manager) when a member resigns or a vacancy exists for other reasons so that the City Council may make an appointment for the unexpired term. Article V - Public Participation A All meetings of the Water Board at which any formal action is taken by such Board shall be public meetings open to the public at all times, except that the foregoing requirement for open meetings shall not apply to the Water Board if the Board determines that the subject for consideration by the Board is such that the best interests of the City or the public or an individual who will be affected by action of the Board could be jeopardized by an open meeting. B. Regular meetings of the Board shall normally be the third Friday of each month at 3 00 p.m in the City Nall The president may designate other times and places for such meetings C. Special meetings of the Board shall be upon call of the president. Notice of special meetings shall be filed with the City Clerk at least twenty-four (24) hours before the time of such meeting by the secretary D The City Clerk is requested to make notices and/or agenda of meetings available to all interested members of the public E. The Board shall utilize all practicable means of communicating its goals and objectives, as well as its recommendations to the City Council, to the general public Public meetings shall be widely publicized when matters of substantial public interest are under consideration. Article VI - Relations with the City Council A Minutes of all meetings of the Board shall be submitted to the City Manager's office in eight copies to be distributed to the Council members and kept on file B. When specific recommendations are made by the Board which require Council action, the City Manager or his representative shall propose them for consideration of the Council unless arrangements are made for the president or other members of the Board to do so. C. The Board shall review all major reports and the proposed budget of the Department of Water Utilities and communicate its views on these documents to the City Council -2- Article VII - Goals and Objectives and Evaluation of Accomplishments A. The Board will adopt periodically a statement of goals and objectives B. Accomplishment of goals and objectives or failure in doing so shall be included in the annual report of the Department of Water Utilities. Article VIII - General Provisions A. Agenda for meetings of the Board shall be prepared by the secretary in consultation with the president and the Director of Water Utilities. B An agenda for regular meetings of the Board together with related papers should be delivered to each Board member by the Tuesday preceding the following Friday meeting. C. A quorum shall consist of five members of the Board. D. Roberts Rules of Order, latest edition, shall govern in the parliamentary procedure of the Board. Article IS- Standing Committees The Board shall organize into the following standing committees and other committees as established from time to time. 1. Engineering Committee 2. Conservation Committee 3. Utilities Service Committee 4. Finance Committee 5 Future Program and Evaluation Committee 6. Legislative Committee Each standing committee shall be responsible for its assignments and make reports and recommendations to the Water Board. Article % - Amendments Amendments to these rules may be proposed at any regular meeting, but may become effective only after a favorable vote at a subsequent meeting. Any of the foregoing rules may be temporarily suspended by a unanimous vote of all members present at any meeting and the vote on such suspension shall be taken by yeas and nays and entered in the official record. -3- Article XII - Maln Wiance of Records A Formal minutes of each meeting shall be taken and maintained as a part of the permanent files Minutes shall show how each member voted in recording action taken by the Board on all matters on which there is not unanimous agreement B. The files will be maintained by the secretary in the offices of the Department of Water Utilities C A copy of such files will be maintained by the City at City Hall. -4-
