OF THE COUNCIL OF THE CITY OF FORT COLLINS
AUTHORIZING THE ACQUISITION BY EMINENT DOMAIN
PROCEEDINGS OF CERTAIN LANDS IN THE CITY
WHEREAS, the City of Fort Collins desires to acquire a right-of-way
over certain lands hereinafter described for the purpose of wideninq
Mulberry Street, and
WHEREAS, the City has attempted to negotiate the acquisition of such
tight-of-way with the owners of the lands, but has been unsuccessful in
such negotiations and it appears it will be necessary to acquire such tight-
of-way through proceedings in eminent domain
NOW, THEREFORE, BE IT RESOLVED BY THE COUNCIL OF THE CITY OF FORT
COLLINS
Section 1 The City Council hereby finds and determines that it is
necessary tnat the City of Fort Collins acquire a right-of-,jay over and
across certain lands more particularly described as follows
A parcel of land situate in the NE 1/4 of Section
16, Township 7 North, Range 69 ;lest of the 6th P M ,
and consiaerina the north line of said NE 1/4 as
bearing West and with all bearings contained herein
relative thereto is contained within the boundary lines
which begin at a point which bears West - 165 00 feet
d again South - it) 00 feet fr oiij the NE cot n- of said
Section 16, thence South - 7 00 feet, thence west -
11 78 feet , tnence along the arc of a 1004 50 foot
radius curve to the right a distance of 74 51 feet, the
long chord of which begins N 87° 52130" W - 74 49 feet,
thence along the arc of a 995 50 foot radius curve to
the left a distance of 73 85 feet, the Iona chord of
ttihich bears N 87 52 ' 29" It - 73 83 feet, thence west -
170 00 feet, thence North - 1 50 feet, thence East -
330 00 feet to the point of beginning Containing
968 01 square feet
to be used for street purposes
Section 2 The City Council hereby finds and determines that it is
not possible to acquire such right of gray by negotiation with the owners
of the land ana , therefore, authorizes the City Attorney and the other
proper officials of the City to acquire such right-of-way for the City by
eminent domain proceedings
Passed and adopted at a regular meeting of the City Council held
this 19th aay of Febt uary, A D 1980
