OF THE COUNCIL OF THE CITY OF FORT COLLIHS
AUTHOPIZING THE ACQUISITION BY EMINENT DOivAIN
PPOCEEDIiJGS OF CERTAIN LANDS IN THE CITY
WHEOEAS, the City of Fort Collins desires to acquire a right-of-way
over certain lands hercinaftei described for the purpose of wideninq
Vulberry Street, and
WHEREAS, the City has attempted to negotiate the acquisition of sucn
rignt-of-way with the owners of the lands, but has been unsuccessful in
such negotiations and it appears it will be necessary to acquire such rignt
of a,ay through proceeaings in eminent domain
NOW, THEREFORE, BE IT PLSOLUED BY THE COUNCIL OF THE CITY OF FORT
COLLINS
Section 1 The City Council hereby finds and determines that it is
necessary that the City of Fort Collins acquire a right-of-Way over and
across certain lands more particularly described as follows
A parcel of land situate in the N'r! 1/4 of Section
15, Townsoip 7 North, Range 169 hest of the 6th P ii ,
and considering the not th line of said Nt; 1/4 as
bearing East, is contained kithin the boundary lines
which begin at a point which bears East , 150 59 teet,
and aaai -i south 30 00 feet fror , the NW 1/4 of �,c d
Section 15, thPrice East - 100 00 feet, thence South -
4 42 Teec, then alonq the a� , �1 a 911E 50 rjoT radius
curvP to tie 1.�tt, a distance of 16 21 feet, the lung
chord of which bears S 87 04' 365" W - 16 21 feet,
thence along the arc of a 1004 50 toot radium curve to
the i iaht a distance of 59 44 feet, the long cnord of
which bears S 8b° 18' 18 5" W - 59 43 feet, trmence west
- 24 41 feet, therce North - 7 00 feet co the point of
beginning Containing 611 42 square feet
to be used for street purpises
Section 2 The City Council hereby finds and determines that it is
not possible to acquire such right of way by negotiation with the owners
of the land and, therefore, authorizes the City Attorney ano the other
proper officials of the City to acquire sucn right-of-gray for the City by
eminent domain proceedings
Passed and adopted at a regular neeting of the City Council held
