OF THE COUNCIL OF THE CITY OF FORT COLLINS
AUTHORIZING THE ACQUISITION BY EMINENT DOMAIN
PROCEEDINGS OF CERTAIN LANDS IN THE CITY
WHEREAS, the City of Fort Collins Desires to acquire a rignt-of-way
over certain lands hereinafter described for the purpose of widening
r"ulberry Street, and
WHEREAS, the City has attemptea to negotiate the acquisition of such
right-of-way with the owners of the lands, but has been unsuccessful in
sucn negotiations and it appears it will be necessary to acquire such right
of way through proceedings in eminent domain
NOW, THEREFORE, BE IT RESOLVED BY THE COUNCIL OF THE CITY OF FORT —
COLLINS
Section 1 The City Council hereby finds and determines that it is
necessary that the City of Fort Collins acquire a right-of-"ay over ana
across certain lands more particularly described as follows
A parcel of land situate in the NW 1/4 of Section 15,
Township 7 Not th, Pange 69 Test of the 6th P Pal , and
considering the north line of said NW 1/4 as bearing
East, is contained within the boundary lines which
begin at a point which bears East, 250 594 feet, and
again South, 30 00 feet front the NW 1/4 of said Section
15, thence East - 124 77 feet , thence South - 3 50
fleet, thence Test - 82 uJ teet, thence along one arc of
a 995 5U foot radius curve to the left, a distance of
42 70 feet, the long chord of which bears S 88° 46'
16 4" lJ - 42 70 feet, thence Nortn - 4 47 feet to the
point of beginning Containing 449 7ZIO square
feet
to be used for street purposes

Section 2 The City Council hereby finds and determines that it is
not possible to acquire such right of way by negotiation with the o.4ners
of the land and, therefore, authorizes tie City Attorney and the other
proper officials of the City to acquire �,ucn right-of-way for the City by
eminent domain proceedings
Passed and adopted at a regular meeting of the City Council held
this 19th day of February, A 0 1980
