OF THE COUNCIL OF THE CITY OF FOPT COLLINS
AUThORIZING THE ACQUISITION BY EM NENT DOMAIN
PROCEEDIiNGS OF CERTAIN LANDS IN THE CITY
WHEREAS, the City of Fort Collins desires to acquire a right-of-way
over certain lands hereinafter described for the purpose of widening
Mulberry Street, and
WHEREAS, the City has attempted to negotiate the acquisition of such
rialit-of-way with the owners of the lands, but has bees unsuccessful in
such negotiations and it appears it will be necessary to acquire such right-
of-way through proceedings in eminent domain
NOW, THEREFORE, BE IT PESOLVED BY THE COUNCIL OF THE CITY OF FORT
COLLINS
Section 1 The City Council hereby finds and determines that it is
necessary that the City of Fort Collins acquire a right-of-way over and
across certain lands more particularly described as follows
A parcel of land situate in the NW 1/4 of Section 15,
Township 7 North, Range 69 'Jest of the 6th P M , and
considerinq the north line of said NI' 1/4 as bearinq
East, is contained within the boundary lines ,4hich
begin at a point which bears Fast, 30 0 feet, and again
South 30 00 feet from the NW 1/4 of said Section 15,
thence East - 120 6 feet , thence South - 7 0 feet ,
thence Hest - 100 1 feet, thence along the arc of a
5 foot rum s -urve to t - 1cft a di�tarc, r + ' '0
feet, the long chord of which bears S 45° 00 ' W - 26 99
feet , thence forth - 27 5 feet to the point of
beginnino Containing 934 39 square feet
ALSO
PARCEL II Beginning at a point which bears East -
30 00 feet, and again South - 57 50 feet, and again N
45' 00' E - 28 99 feet from the nortnwest corner of
Section 15 , Township 7 North, Range 69 rJest of the
Sixth P M , thence East - 3 00 feet, thence Soutn -
3 00 feet, thence hest - 3 00 feet, thence North - 3 00
feet to the point of beginning Containing 9 00
feet
to be used for street purposes
Section 2 The City Council hereby finds and determines that it is
not possible to acquire such right of way by negotiation with the owners
of the land and, therefore, authorizes the City Attorney and the other
proper officials of the City to acquire such right-of-way for the City by
eminent doraai n proceedings
Passed and adopted at a regular meeting of the City Council held
