OF THE COUNCIL OF THE CITY OF FORT COLLINS
AUTHORIZING ThE ACQUISITION BY EMIiNENT DOiiAIN
PROCEEDINGS OF CERTAIN LANDS IN THE CITY
WHEREAS, the City of Fort Collins desires to acquire a right-of-way
over certain lands hereinafter described for the purpose of widening
iu 1 berr y Street, and
WHEREAS, the City has attempted to negotiate the acquisition of sucn
right-of-way with the owners of the lands, but has been unsuccessful in
sucn negotiations and it appears it will be necessary to acquire such right
of way through proceedings in eminent domain
NOW, THEREFORE, BE IT RESOLVED BY THE COUNCIL OF THE CITY OF FORT
COLLINS
Section 1 The City Council hereby finds and determines that It IS
necessary that the City of Fort Collins acquire a right-of-way over and
across certain lands more particularly described as follows
A parcel of land situate in the SE 1/4 of Section 9,
Township 7 Nortn, Range 69 West of the 6th P h , and
considering the north line of said SE 1/4 as bearing N
89° 35 ' 30" W and all bearings contained herein
relative thereto is contained within the boundary lines
which begin at a point which bears N 89' 35 ' 30" W -
30 00 feet and again Nortn - 30 00 feet from the SE
corner of said Section 9 thence North - 27 51 teet,
thence along the arc of a 20 50 foot radius cur ve to
the right a dista, ce of 29 01 1zL-'., the lony 0iord of
which bears S 45' 12 ' 15" W - 32 35 feet, thence N 890
35 ' 30" W - 125 87 feet , thence along the arc of a
1004 50 foot radius curve to the left a distance of
74 51 feet, the long chord of which bears S 88* 16' 59"
W - 74 49 feet, thence along the arc of a 995 50 foot
radius curve to the right a distance of 34 98 feet, the
long chord of ti,hich bears S 87' 09 ' 55" W - 34 98 feet,
thence S 00° 02' 15" E - 2 26 feet, thence S 89' 35'
30" E - 255 92 feet to the point of beginning Con-
taining 1663 67 square feet

PARCEL II Beginning at a point vnich bears N 89° 35 '
30" W - 30 00 feet and again North - 57 51 teet, and
again S 45 12 ' 15" W - 29 09 feet from the southeast
corner of Section 9, Townsnip 7 Horth, Range 69 West of

feet, thence Soutn 3 00 feet to the point of beginning
Containing 9 00 souare feet
to be used for street purposes
Section 2 The City Council hereby finds and determines that it is
not possible to acquire such right of way by negotiation with the owners
of tfie land and, therefore, authorizes the Lity Attorney and the other
proper officials of the City to acquire such right-of-way for the City by
e, inent domain proceedings
Passed and adopted at a regular meetinq of the City Council held
this 19th day of February, A D 1980
