HomeMy WebLinkAbout1980-038-04/01/1980-AUTHORIZING THE CITY TO ENTER INTO AN AGREEMENT WITH THE UNION PACIFIC RAILROAD COMPANY TO PROVIDE F RESOLUTION 80-38 OF THE COUNCIL OF THE CITY OF FORT COLLINS AUTHORIZING THE CITY TO ENTER INTO AN AGREEMENT WITH THE UNION PACIFIC RAILROAD COMPANY TO PROVIDE FOR THE INSTALLATION AND MAINTENANCE OF AUTOMATIC FLASHING LIGHT SIGNALS AT THE INTERSECTION OF THE UNION PACIFIC RAILROAD TRACKS AND LEMAY AVENUE WHEREAS, THE COUNCIL OF THE CITY OF FORT COLLINS has before it a proposed agreement covering the installation and maintenance of automatic flashing light signals on the right-of-way of the railroad company at mile post 23 8, at East Laurel , Lemay, and Riverside Avenue in the City of Fort Collins, Colorado, and has given said agreement careful review and consid- eration, and WHEREAS, in the considered opinion of the Council of the City of Fort Collins it is in the best interest of the City that the terms of said agreement be accepted NOW, THEREFORE, BE IT RESOLVED BY THE COUNCIL OF THE CITY OF FORT COLLINS as follows Section 1 That the City be, and it hereby is, authorized and direct- ed to enter into a contract with the Union Pacific Railroad Company upon the following terms and conditions (a) That the railroad install and maintain railroad protection crossing devices at the subject intersection in accordance with the plans and specifications on file in the office of the City Engineer (b) That funding for the installation and maintenance of the afore- mentioned crossing protection device shall be apportioned between the parties as follows (1) State of Colorado (Highway Crossing Protection Fund) 70% (2) Union Pacific 10% (3) City of Fort Collins 20% (c) That actual costs incurred by the railroad for work performed on the construction of the crossing itself shall be borne entirely by the City (d) That the City accepts the contractors estimates on the costs of the work to be performed (e) That the terms of tfie aforementioned agreement are subject to approval by tfie Public Utilities Commission of the State of Colorado Section 2 That the Mayoi of the City of Fort Collins be, and he hereby is, authorized and directed to execute said agreement on behalf of the City, and that the City Clerk of the City of Fort Collins is hereby authorized and directed to attach to said agreement a certified copy of this Resolution Passed and adopted at a regular meeting of the City Council held this 1st day of April A D 1980 PI QQ A CJ4 Xroi- May ATT T Ci Clerk -2-
