HomeMy WebLinkAbout1980-057-04/29/1980-AUTHORIZING THE CITY TO ENTER INTO INTERGOVERNMENTAL AGREEMENTS WITH THE STATE BOARD OF AGRICULTURE RESOLUTION 80-57 OF THE COUNCIL OF THE CITY OF FORT COLLINS AUTHORIZING THE CITY TO ENTER INTO INTER- GOVERNMENTAL AGREEMENTS WITH THE STATE BOAPD OF AGRICULTURE AND THE UNITED STATES DEPARTMENT OF ENERGY FOR THE CONSTRUCTION OF A UTILITY BANK DUCT ON OVERLAND TRAIL AND ACCEPTING EASEMENTS THEREFOR BE IT RESOLVED BY THE COUNCIL OF THE CITY OF FORT COLLINS as follows Section 1 That the City Manager be, and he hereby is, authorized and directed to enter into Easement Agreements with the State Board of Agriculture under the terms of which the City would be granted easements for the purpose of constructing a utility duct bank along Overland Trail between Sumac Street and County Road No 42C and between Mulberry and Elizabeth Streets Section 2 That the City Manager be, and he hereby is, authorized and directed to enter into an Intergovernmental Agreement with the United States Department of Energy, Western Area Power Administration, under the terms of which the City would be granted permission to construct a utility duct bank in the vicinity of Overland Trail on, over, under and across United States right-of-way Section 3 That the easements described on Exhibit A attached hereto be, and the same hereby are, accepted on behalf of the City Passed and adopted at a regular meeting of the Council of the City of Fort Collins held this 15th day of A ril May 1980 r 'MfST C`Tty Clerk �� �� Exhibit A A fifteen foot wide, underground powerline easement for the City of Fort Collins, Colorado, located in the NE 1/4 of Section 17, Township 7 North, Range 69 West of the 6th P M , Larimer County, Colorado, being the west 15 feet of the east 45 feet of the tract of land described as follows The north half of Section 17 T7N9 R 69 W of the 6th P M , with the excep- tion of a tract described as beginning at the NE corner of said Section 17, thence south along the section line 435 70 feet, thence west 285 feet, thence north 410 81 feet to the north section line, thence N 85*0013011 E 286 09 feet to the point of beginning (The above describes a 15' wide underqround powerline easement along the west side of S Overland Trail Road right-of-way on the land owned by the State Board of Agriculture, between Mulberry and Elizabeth Streets This easement is contained entirely within the boundaries of the existing Western Area Power Aoministration easement ) And A fifteen foot wide, underground powerline easement for the City of Fort Collins, Colorado, located in the E 1/2 of Section 20, Township 7 North, Range 69 West of the 6th P M , Larimer County, Colorado, being the west 15 feet of the east 45 feet of the tract of land described as follows Beginning at the east quarter corner of Section 20 Township 7 North Range 69 West of the 6th P M thence S 0*14' W 1390 9 feet, thence S 87059' W 1473 5 feet, thence S 78025' W 1214 3 feet, thence N 0028' E 2451 0 feet, thence N 57*44 ' E 66 1 feet, thence on a regular curve to the left a radius of 336 48 feet for 149 4 feet, thence N 32*17' E 0 2 feet, thence on a regular curve to the left with a radius of 240 99 feet 133 2 feet, thence N 0*27' E 111 2 feet, thence on a regular curve to the right with a radius of 236 48 feet, 99 5 feet, thence N 86023' E 2437 4 feet, thence S 0014 ' W 1391 7 feet to the point of beginning (The above describes a 15 ' foot wide underground powerline easement along the west side of S Overland Trail Road right-of-way, on the land owned by the State Board of Agriculture between Sumac Street and County Road No 42C This easement is contained entirely within the boundaries of the existing Western Area Poser Administration easement }
