OF THE COUNCIL OF THE CITY OF FORT COLLINS
AUTHORIZING THE GRANT OF A LICENSE TO ENTER ON
CITY PROPERTY TO VERIZON WIRELESS
WHEREAS,the City of Fort Collins is the owner of a certain parcel of real property located
in Larimer County, Colorado, more particularly identified as Tract A, Fort Collins Senior Center
P.U.D. (the"Property"); and
WHEREAS, the City of Fort Collins and Verizon Wireless (VAW), LLC, d/b/a Verizon
Wireless ("Verizon Wireless") are currently negotiating the possible lease of a portion of the
Property to Verizon Wireless to be used for the installation of a cell tower(the"Project"); and
WHEREAS, Verizon Wireless has requested a license to enter onto the Property for the
purpose of conducting engineering and environmental surveys for the Project(the"License"); and
WHEREAS, Verizon Wireless has indicated that its activities on the Property would not
include any invasive sampling, such as drilling or digging; and;
WHEREAS,City staff has reviewed the request by Verizon Wireless, and believes that said
surveys or survey crews will not interfere with or adversely affect the Property, based on current
expectations; and
WHEREAS, as a condition of the License, Verizon Wireless will be required to repair any
damage to the Property and to complete its work on the Property within six months; and
WHEREAS, Article XI, Section 10, of the Charter of the City of Fort Collins authorizes the
Council to permit the use or occupation of any street, alley, or public place, provided that such
permit shall be revocable by the Council at its pleasure, whether or not such right to revoke is
expressly reserved in such permit.
NOW, THEREFORE, BE IT RESOLVED BY THE COUNCIL OF THE CITY OF FORT
COLLINS that the Mayor is hereby authorized to execute such documents as are necessary to grant
a License to Enter to Verizon Wireless (VAW), LLC d/b/a Verizon Wireless, consistent with the
terms of this Resolution, together with such additional terms and conditions as the City Manager,
in consultation with the City Attorney,deems necessary or appropriate to protect the interests of the
City or to effectuate the purposes of this Resolution,including any necessary corrections to the legal
description of the Property that do not result in a material increase or change in character of the
license area.
