RESOLUTION 97-25 OF THE COUNCIL OF THE CITY OF FORT COLLINS ADOPTING THE COMMUNITY VISION AND GOALS 2015, CITY STRUCTURE PLAN, AND CITY PLAN PRINCIPLES AND POLICIES AS ELEMENTS OF THE COMPREHENSIVE PLAN OF THE CITY WHEREAS, on March 3, 1995, the City issued a Request for Proposals outlining a multi- phase land use planning process and soliciting proposals from outside consultants to work with City staff in developing a new Comprehensive Plan for the City,to be known as the"City Plan"; and WHEREAS,the purpose of the new Comprehensive Plan was to describe goals,and a vision of what might be along with clear policies as a guide to decision making about the future of the community; and WHEREAS,the citizens of the City of Fort Collins have devoted an extraordinary amount of time and effort in developing the new Comprehensive Plan for the City; and WHEREAS,the general public has had the opportunity to review and comment on the new Comprehensive Plan; and WHEREAS, by Resolution 96-46, the Council of the City of Fort Collins adopted the "Community Vision and Goals 2015"section of the Fort Collins City Plan as an element of the new Comprehensive Plan of the City; and WHEREAS,by Resolution 96-79,the Council of the City of Fort Collins adopted the "City Structure Plan"section of the Fort Collins City Plan as an element of the new comprehensive plan of the City; and WHEREAS,by Resolution 96-136,the Council of the City of Fort Collins adopted the"City Plan Principles and Policies" section of the Fort Collins City Plan as an element of the new comprehensive plan of the City; and WHEREAS, subsequent to the adoption of the foregoing sections of the Fort Collins City Plan, the staff and professional consultants of the City, together with the City Plan Advisory Committee and other citizen groups of the City (with continuous opportunity for review and comment by the community at large) have closely examined the foregoing sections of the Fort Collins City Plan and have recommended certain modifications to better perfect the documents; and WHEREAS,the City Plan"Community Vision and Goals 2015", "City Structure Plan",and "City Plan Principles and Policies", as modified since their adoption, serve together, and respectively, as (a) a flexible guide in determining more specific policies, programs and projects necessary to implement the Vision and Goals; (b)an illustration of the basic kinds of"places"that make up the city and include a general graphic illustration of the overall vision of the city; and(c) a compilation of fundamental principles upon which the City Plan will be implemented and policies regarding how the implementation ought to proceed; and WHEREAS, upon review of the revised "Community Vision and Goals 2015", "City Structure Plan", and "City Plan Principles and Policies" sections of the City Plan, and following public hearings by both the City Council and the Planning and Zoning Board (the "Board"), and having received the recommendation of the Board, the City Council has determined that the foregoing sections of the City Plan should now be re-adopted as elements of the Comprehensive Plan of the City, together with certain amendments that have recently come to the attention of the Council, which are set forth on Appendix "A" attached hereto and incorporated herein by this reference. NOW,THEREFORE,BE IT RESOLVED BY THE COUNCIL OF THE CITY OF FORT COLLINS, as follows: Section 1. That the Section of the City Plan entitled "Community Vision and Goals 2015,"dated February 18, 1997,a copy of which is on file in the office of the City Clerk, is hereby adopted by the City Council and approved for incorporation into the City's Comprehensive Plan(as amended pursuant to Appendix"A"). Section 2. That the section of the City Plan entitled"City Structure Plan"dated February 18, 1997, a copy of which is on file in the Office of the City Clerk, is hereby adopted by the City Council and approved for incorporation into the City's Comprehensive Plan(as amended pursuant to Appendix"A"). Section 3. That the section of the City Plan entitled"City Plan Principles and Policies" dated February 18, 1997, a copy of which is on file in the Office of the City Clerk,is hereby adopted by the City Council and approved for incorporation into the City's Comprehensive Plan(as amended pursuant to Appendix"A"). Section 4. That said"Community Vision and Goals 2015", "City Structure Plan", and "City Plan Principles and Policies"shall take effect on the same day that the implementation of the City Plan(to be known as the City of Fort Collins Land Use Code) goes into effect. Section 5. That at the time that the foregoing sections of the City Plan go into effect,the previously existing elements of the City's Comprehensive Plan known as the"Goals and Objectives" dated August 1977(as subsequently amended) and the"Land Use Policies Plan"dated August 14, 1979 (as subsequently amended) shall expire and shall be of no further force and effect, except to the extent that said "Goals and Objectives" and "Land Use Policies Plan" are necessary for the review of applications for approval of overall development plans and preliminary planned unit development plans filed prior to March 28, 1997,and except as provided in Section 3 of Ordinance No. 161, 1996. Amend the second bullet under Policy GM-5.1 of the City Plan Principles and Policies as follows: • New roads and other City services shall not be extended to serve development which is inconsistent with City Plan or other regional plans as adopted by the City. Moreover, the City shall not enter into any agreements with other jurisdictions to jointly fund or construct infrastructure improvements or provide services that might foster growth which is inconsistent with these plans. These policies will not preclude the City from working with other jurisdictions to provide services and facilities which benefit the entire community such as water and wastewater facilities, regional trails, open space and parks. 2. Amend the following terms contained in the City Plan Principles and Policies and the Community Vision and Goals 2015 documents as follows: Previous Term New Term Urban Growth Area Boundary Community Growth Management Area Stage 2 Urban Growth Area Boundary Cooperative Planning Area Cooperative Planning Area Community Influence Area 3. Amend GM-1.2 Cooperative Planning Area of the City Plan Principles and Policies as follows: • "Policy GM-1.1 Cooperative Planning Area. The City will collaborate with Larimer County in establishing a Cooperative Planning Area (CPA) surrounding the Fort Collins Urban Growth Area boundary. The purpose of such area is to provide the City with a formal mechanism for providing input to the County with regard to County actions that may have significant impacts on the city, including, but not limited to, land use, infrastructure planning, development standards, and fees, as well as the identification of areas suitable for preservation or future development. The intent of the CPA is not for future urban development or annexation to the City, although some areas may be suitable for such purposes as described below in GM-1.3 Stage 2 Urban Growth Area Boundary." 4. Amend Policy GM-1.3 Stage 2 Urban Growth Area Boundary of City Plan Principles and Policies as follows; • "Policy GM-1.3 Stage 2 Urban Growth Area Boundary. The City will collaborate with Larimer County to explore establishing a Stage 2 Urban Growth Area boundary (See Figure GM-1.1). The objective of the Stage 2 area is to preserve opportunities to expand the supply of buildable land for urban purposes within the city when the Stage 1 Urban Growth boundary is filled in. The decision whether to expand urban development into these areas will be made as part of a comprehensive update of City Plan In the interim, new residential development in the Stage 2 area should be permitted as clustered development, so that large parcels of land may remain for future urban development, as well as forming an edge to the community. "Future urbanized area development standards" will be prepared to apply to all new development within the Stage 2 area in order to ease the transition of these areas from rural to urban in the future.. Such standards may include street pattern and connectivity, right-of-way dedication for public streets, drainage and utility easements, and engineering design standards. The precise boundaries, terms, conditions, and requirements of the Stage 2 area will be defined and implemented through an intergovernmental agreement with Larimer County, in collaboration with affected property owners" 5. Amend the third bullet of Policy GM-1.6 Transfer of Development Rights of City Plan Principles and Policies as follows: • "Receiving areas. Locations for potential receiving areas, capable of accommodating the development to be transferred, shall be specifically defined and designated. No receiving areas shall be designated within three miles of the City's Urban Growth boundary(Stage 1).Exceptions to the three mile radius may be made for properties located outside the City limits but within the UGA, and the Fossil Creek Reservoir Area." 6. Delete the term "accessory uses" from the "Glossary of Planning Terms" contained in the Community Visions and Goals 2015 and City Plan Principles and Policies document. 7. Amend the definitions of the terms "convenience shopping centers" and "dwelling" in the glossary of terms contained in the City Plan Principles and Policies document as follows: Convenience Shopping Center - ".....adjacent employment areas....neighborhood convenience stores... Dwelling-"...but not including hotels,motels,fraternity and sorority houses,and other similar group accommodations;and,tents or other structures designed or used primarily for temporary occupancy. 8. Amend the titles in the Community Vision and Goals 2015 document as follows:
