OF THE COUNCIL OF THE CITY OF FORT COLLINS
AUTHORIZING A GRANT AGREEMENT WITH THE STATE OF COLORADO AND AN
INTERGOVERNMENTAL AGREEMENT WITH LARIMER COUNTY TO RECEIVE
GRANT FUNDS FROM THE STATE OF COLORADO FOR CONSTRUCTION OF TRAILS
AND OTHER PUBLIC IMPROVEMENTS AT SOAPSTONE PRAIRIE NATURAL AREA
WHEREAS, the City is the owner of property known as"Soapstone Prairie Natural Area";
and
WHEREAS, the City intends to open Soapstone Prairie Natural Area for public recreation
in 2009,with trails and other public improvements available for public use; and
WHEREAS,on July 1, 2008, the City jointly applied with Larimer County for a grant from
the State of Colorado's Great Outdoors Colorado Trust Fund(GOCO)to fund a portion of the cost
of constructing trails and other public improvements at Soapstone Prairie Natural Area and the
County's Red Mountain Open Space; and
WHEREAS this construction project is called the Larimer Foothills Trail Development
Project(the "Project"); and
WHEREAS,Latimer County was the applicant for the grant and the City of Fort Collins was
the primary partner; and
WHEREAS,on October 3,2008 the GOCO Board approved the grant application in the total
amount of$550,000, of which$210,000 is allocated to the City of Fort Collins and$340,000 goes
to Larimer County; and
WHEREAS, the total cost of the Project is estimated at $1,386,880; and
WHEREAS, the City's share of the cost is available for expenditure in the Natural Areas
Program fund; and
WHEREAS, to receive the grant funds, the City must sign a Grant Agreement(the "Grant
Agreement")with the State of Colorado and enter into an intergovernmental agreement(the"Project
Agreement") with Larimer County, copies of which are on file in the office of the City Clerk and
available for public inspection; and
WHEREAS, the City is authorized, under Article II, Section 16 of the Charter of the City
of Fort Collins and Section 29-1-203, C.R.S., to enter into intergovernmental agreements, such as
the Grant Agreement and the Project Agreement, to provide any function, service or facility; and
WHEREAS,the Grant Agreement requires that the facilities constructed during this Project
be maintained in a reasonable state of repair for the purposes specified in the Project Application
for not less than 25 years; and
WHEREAS,the Grant Agreement further requires that the Project be completed by October
2010; and
WHEREAS, City staff recommends that the City Council authorize the Grant Agreement
and the Project Agreement as described herein.
NOW, THEREFORE, BE IT RESOLVED BY THE COUNCIL OF THE CITY OF FORT
COLLINS as follows:
Section 1. That the City Manager is hereby authorized to enter into a Grant Agreement
with the State of Colorado for the receipt of State of Colorado Great Outdoors Colorado funds, to
be used for construction of trails and other public improvements,on terms and conditions consistent
with the terms of this Resolution, along with such additional terms and conditions as the City
Manager, in consultation with the City Attorney, deems necessary and appropriate to protect the
interests of the City.
Section 2. That the City Manager is hereby authorized to enter into the Project
Agreement with Latimer County to acknowledge the City's partnership in the Latimer Foothills
Trails Development Project and outline each party's responsibilities as identified in the Project
Application, on terms and conditions consistent with the terms of this Resolution, along with such
additional terms and conditions as the City Manager,in consultation with the City Attorney,deems
necessary and appropriate to protect the interests of the City.
