OF THE COUNCIL OF THE CITY OF FORT COLLINS
APPROVING IN CONCEPT A STORMWATER MANAGEMENT
STRATEGY KNOWN AS DITCH CONSOLIDATION
WHEREAS, the Council of the City of Ft Collins is desirous of a-
chieving for its citizens certain protection from potential damages result-
ing from runoff caused by the severe thunderstorms which are common to this
region, and
WHEREAS, such protection is sought by the Council at a cost which is
reasonable and affordable to the citizens of the City, keeping in mind the
inherent risks and various alternative methods of achieving such protec-
tion, and
WHEREAS, a method has been developed whereby through mutual cooper-
ation with the New Mercer Ditch Company and the Larimer County Canal No 2
Irrigation Company, the City of Ft Collins can, through consolidation,
utilize facilities of the ditch companies for the conveyance and disposal
of storm water runoff, and
WHEREAS, this proposal appears to offer to both the City and the ditch
companies reciprocal benefits for the City possible storm water protection
and better utilization of the 173 water stock and for the Ditch Companies
reduced maintenance costs and guaranteed water supplies, and
WHEREAS, notwithstanding certain reservations expressed on the part of
the Storm Drainage Board and the Water Board for good and valid reasons
regarding possible costs and benefits to the City (which issues need
further investigation and clarification) the City Council believes the
concept known as Ditch Consolidation as it is embodied in the draft agree-
ment attached has considerable merit, and
WHEREAS, the City Council is desirous of expressing its support of the
concept to the stockholders and officers of the Ditch Companies and of
continuing negotiations with the Ditch Companies regarding the matter
NOW, THEREFORE BE IT RESOLVED BY THE COUNCIL OF THE CITY OF FORT
COLLINS, COLORADO AS FOLLOWS
SECTION 1 That the Council of the City of Fort Collins declare
to the stockholders and officers of the New Mercer Ditch Company and the
Larimer County Canal No 2 Irrigating Company and to any other ditch
companies or other entities who may have an interest in the proposed
agreement or any modification thereof, that the concept of ditch consol-
idation appears to have considerable merit and may offer significant
benefits to all parties
SECTION 2 That the City Council recognizes that there may remain
unresolved issues with regard to the ultimate benefits and costs to the
citizens of the City and to the stockholders of the ditch companies
SECTION 3 That the City Council urges the stockholders of the
ditch companies to carefully consider the proposed agreement and the
implications thereof and to communicate to the City their thoughts and
opinions thereon
SECTION 4 That the City Council expresses its appreciation to
the Storm Drainage Board and the Water Board for their comments and input,
and requests that these boards continue to investigate and analyze the
potential costs and benefits to the City and make a final recommendation
to the City Council after due deliberation upon the best available infor-
mation
Passed and adopted at a regular meeting of the City Council held this
