OF THE COUNCIL OF THE CITY OF FORT COLLINS
APPROVING THE ACCEPTANCE OF THE PROPOSED DONATION
OF THE SCULPTURE "TRANSCEND"
WHEREAS, in the summer of 2007, David Neenan and the Neenan Family L.L.L.P.
("Neenans"),in cooperation with the Downtown Development Authority(DDA),commissioned the
artist Collen Nyanhongo to create a sculpture, titled "Transcend" (the "Artwork"); and
WHEREAS, the Artwork was sculpted in Old Town Square so that members of the public
would be able to better appreciate the artistry involved in creating such works of art; and
WHEREAS, the DDA wishes to relocate the Artwork and partner with the City to create
another art attraction in the same location in Old Town Square this summer; and
WHEREAS, to accommodate those objectives, the Neenans wish to donate the Artwork to
the City; and
WHEREAS, the value of the Artwork is estimated at over,$10,000; and
WHEREAS, if the donation is accepted, the Artwork would be moved to a public location
on City property; and
WHEREAS, Section 23-309 of the City Code requires that works of art with a value of$300
or more donated to the City to be placed in a public area may be accepted only with approval of the
Art in Public Places Board(the"APP Board"), and all such works with a value of$10,000 or more
may be accepted only with approval of the City Council,upon review of the proposed donation and
the recommendation of the APP Board; and
WHEREAS, at its regular meeting on February 18, 2009, the APP Board evaluated the
proposed donation of the Artwork based on the City's Art in Public Places Guidelines and
recommended that the City Council accept the donation.
NOW, THEREFORE, BE IT RESOLVED BY THE COUNCIL OF THE CITY OF FORT
COLLINS,that the City Council hereby accepts the proposed donation of the sculpture"Transcend",
created by artist Collen Nyanhongo.
