AMENDING AND OVERRULING THE DECISI
OF THE PLANNING AND ZONING BOARD
WHEREAS, on June 27 , 1983 , the Planning an of the
Council of the City of Fort Collins considered arral , a
proposal submitted by Joseph C Roesser, Jr fof the development of a
portion of the Pine Ridge Open Space Area pres tly owned by the City of
Fort Collins, and
WHEREAS, after discussion and public h ring concerning the same, the
Planning and Zoning Board recommended to he County of Larimer that the
said proposal be approved contingent up development upon said property
not extending above the "ridgeline" of t e said property, and
WHEREAS, the Planning and Zonin Board further conditioned its appro-
val on the retention by the City o a fifty foot (50' ) landscape easement
along the westerly side of t/estlished property line (ridgeline) of the
said property, and
WHEREAS, the Council ofty of Fort Collins has determined that
it is in the best intereste citizens of the City that the said
ruling of the Planning and/Zoning Board be modified and overruled with
respect to the aforementio d contingencies
NOW, THEREFORE, B IT RESOLVED BY THE COUNCIL OF THE CITY OF FORT
COLLINS that the deci7ion of the Planning and Zoning Board making recom-
mendation to the Cou ty of Lan mer be overruled, amended and modified to
provide that the de elopment to be constructed upon the aforesaid property
be constructed at n elevation not to exceed the treeline (defined as that
elevation five f t [5' ] below the average height of the five highest trees
