HomeMy WebLinkAbout2008-065-07/15/2008-AUTHORIZING A GRANT AGREEMENT WITH THE STATE OF COLORADO FOR THE POWER TRAIL RESOLUTION 2008-065 OF THE COUNCIL OF THE CITY OF FORT COLLINS AUTHORIZING A GRANT AGREEMENT WITH THE STATE OF COLORADO FOR THE POWER TRAIL WHEREAS,the City's Power Trail is an important north/south recreation and commuter trail for southeast Fort Collins; and WHEREAS,the City recently applied for and received a grant from the Colorado State Parks State Trails Program for $350,000 in Great Outdoors Colorado (GOCO) funds to construct a new two-mile long section of the Power Trail south of Harmony Road(the "Project"); and WHEREAS, the total cost of the Project is estimated at $650,000; and WHEREAS, the City's share of the cost is available for expenditure in the Conservation Trust Fund; and WHEREAS, to receive the grant funds, the City must enter into a grant agreement with the State of Colorado Department of Natural Resources, Division of Parks and Recreation("State"), a copy of which is on file in the office of the City Clerk and available for public inspection(the"Grant Agreement"); and WHEREAS,the City is authorized,under Article II, Section 16 of the Charter of the City of Fort Collins and Section 29-1-203, C.R.S, to enter into intergovernmental agreements,such as the Grant Agreement, to provide any function, service or facility; and WHEREAS,the Grant Agreement requires that the land used for the Project not be converted to any non-recreational use in the future without prior written approval of the State; and WHEREAS,the Grant Agreement further requires that the Project be completed by June 20, 2010; and WHEREAS, City staff recommends that the Council authorize the Grant Agreement as described herein. NOW, THEREFORE, BE IT RESOLVED BY THE COUNCIL OF THE CITY OF FORT COLLINS that the City Manager is hereby authorized to enter into an intergovernmental agreement with the State of Colorado for the receipt of Colorado State Parks State Trails Program GOCO funds, to be used for the construction of a section of the Power Trail, on terms and conditions consistent with the terms of this Resolution, along with such additional terms and conditions as the City Manager, in consultation with the City Attorney, deems necessary and appropriate to protect the interests of the City.
