OF THE COUNCIL OF THE CITY OF FORT COLLINS
AUTHORIZING THE CITY MANAGER TO ENTER INTO
AN ASSIGNMENT AND ASSUMPTION AGREEMENT
WITH ANHEUSER - BUSCH, INC. CONCERNING
THE CONSTRUCTION OF AN INTERCHANGE AT INTERSTATE 25
AND LARIMER COUNTY COLORADO ROAD 50
WHEREAS Anheuser - Busch Inc has entered into an agreement with the
State Department of Highways, State of Colorado, State Highway Commission
of the State of Colorado for the construction of an interchange facility at
Interstate Highway 25 and Larimer County Road 50; and
WHEREAS, pursuant to the terms of the Interchange Agreement the City
of Fort Collins may undertake on behalf of Anheuser -Busch, Inc. the duties
and obligations and obtain the benefits to the Interchange Agreement;
and
WHEREAS, Anheuser - Busch, Inc, has formally requested the City of
Fort Collins to undertake the obligations and obtain the benefits of the
Interchange Agreement and to execute an Assignment and Assumption Agreement
to accomplish the same; and
WHEREAS, in the event that the City of Fort Collins undertakes the
obligations of Anheuser - Busch, Inc. in regard to the Interchange Agree-
ment, the City of Fort Collins shall be reimbursed by Anheuser - Busch for
such obligation pursuant to the Master Agreement between the City of Fort
Collins and Anheuser - Busch, Inc. dated December 31, 1982.
NOW, THEREFORE, BE IT RESOLVED BY THE COUNCIL OF THE CITY OF FORT
COLLINS that the City Manager is hereby authorized to, on behalf of the
City, enter an Assignment and Assumption Agreement between the City and
Anheuser - Busch, Inc. , whereby the City will undertake the obligations of
Anheuser - Busch, Inc. in regard to the Interchange Agreement approved by
the State Department of Highways, State of Colorado, and the State Highway
Commmission, on the 12th day of April , 1984.
Passed and adopted at a regular meeting of the City Council of Fort
Collins held on the 17th day of July, 1984.
