AUTHORIZING THE CITY MANAGER TO LEASE
THE OLD POWER PLANT TO COLORADO STATE UNIVERSITY FOR A
CENTER FOR ENGINES, ENERGY AND VEHICLE EMISSIONS RESEARCH AND TESTING.
WHEREAS, the Council of the City of Fort Collins ("City Council ") has
determined that the promotion of energy efficiency and improved air quality are
areas of high priority to the citizens of Fort Collins; and
WHEREAS, Colorado State University's Department of Mechanical Engineering
("the University") is capable of conducting research in the fields of energy
efficiency and vehicle emission controls which can directly and indirectly
benefit the residences, businesses and industries of Fort Collins; and
WHEREAS, the University has determined that the use of the "Old Power
Plant" could assist the University's research and training in the areas of energy
efficiency and emission control ; and
WHEREAS, to facilitate the use of the "Old Power Plant" as a research
laboratory for the aforementioned purposes, the City wishes to lease the "Old
Power Plant" to the University for said beneficial uses; and
WHEREAS, the City Council has determined that said energy efficiency and
air quality research is in the public interest and serves a valid public purpose;
and
WHEREAS, Article II, Section 16, of the Charter of the City and Section 29-
1-203(1) of the Colorado Revised Statutes authorize the Council to enter into
cooperative or joint activities with other governmental bodies.
NOW, THEREFORE, BE IT RESOLVED BY THE COUNCIL OF THE CITY OF FORT COLLINS
as follows:
Section 1 . That the City Manager is hereby authorized to enter into a six
(6) month lease with the University to allow the University, upon the payment to
the City of One Dollar ($1 .00) as consideration for said lease, to use the "Old
Power Plant" for conducting research and testing on internal combustion engines
for the purpose of improving the energy efficiency of such engines and of
reducing pollutant emissions from such engines. Said lease may be extended for
no more than three (3) consecutive additional two (2) month periods at the sole
discretion of the City following application for any such extension(s) by the
University.
Section 2. The aforesaid lease is in the best interests of the City.
Passed and adopted at a regular meeting of the Council of the City of Fort
Collins held this 5th day of May, A.D. 1992.
