HomeMy WebLinkAbout2003-027-02/18/2003-SUBMITTING TO THE REGISTERED ELECTORS OF THE CITY A PROPOSED CHANGE IN THE USE OF THE BUILDING COMMU RESOLUTION 2003-027 OF THE COUNCIL OF THE CITY OF FORT COLLINS SUBMITTING TO THE REGISTERED ELECTORS OF THE CITY A PROPOSED CHANGE IN THE USE OF THE BUILDING COMMUNITY C CES QUARTER CENT SALES AND USE TAX REVENUES PRESENTL DESIGNATED FOR PROSPECT ROAD IMPROVEMENTS WHEREAS, on April 8, 1997, the registered electors of the City auth ized the adoption of Ordinance No. 31, 1997, (the Ordinance ) which extended a quarter-cen ales and use tax for a period of eight years for the purpose of obtaining funds for the construc * n of certain community enhancement capital projects as described in the"Building Community C ices"capital improvement program; and WHEREAS, one of the projects to be funded by h tax is the "Prospect Road Improvements, Poudre River to Summitview," (the "Project" hich project consists of widening Prospect Road from the Poudre River to Summitview Drive as to provide bicycle lanes,two travel lanes,a left turn lane and a sidewalk to enhance the safety o icyclists,pedestrians and motorists,and so as to protect the roadway from major floods; and WHEREAS, City staff has informed the Ci Council that the Project, as described to the voters and as described in the Ordinance, is incon ' ent with the current transportation needs of the City and, if constructed, would necessitate, in e near future, the removal and reconstruction of certain portions of the Project; and WHEREAS, for this reason, th ity Council believes that the tax revenues presently earmarked for the Project could be bet utilized if they were made available for any transportation capital project that may be designate y the Council as being among the highest priorities on the City's Master Street Plan; and WHEREAS,the Ordin ce requires that the Project be undertaken and completed by the City as described in the Ordinanc nless the City Council determines that the Project is no longer legally or financially feasible; and WHEREAS, the reasons stated above, the City Council believes that the Project has become inadvisable though the Project remains legally and financially feasible; and WIE S, the City Council wishes to seek approval of the voters to change the purpose for which thi ortion of the Building Community Choices tax revenues can be utilized; and REAS, the next regular election of the City is scheduled to be held on April 8, 2003. NOW, THEREFORE, BE IT RESOLVED BY THE COUNCIL OF THE CITY OF FORT C INS that the following question be submitted to the registered electors of the City at the r ular election of the City which is scheduled to be held on April 8, 2003: Failed to Pass 3-4 February 18, 2003 BALLOT ISSUE NO. 3 A City-initiated Measure Proposing a Change in Use of a Portion of e "Building Community Choices" Tax Revenues Shall that portion of the existing sales and use tax revenues for t `Building Community Choices" Capital Improvement Program imposed by Ord' ance No. 31, 1997, of the City of Fort Collins, which is currently designated for ' provements to Prospect Road, from the Poudre River to Summitview, be used ' tead to help pay for any transportation capital improvement project that may be ignated by the City Council as one of the highest priority transportation projects own on a twenty(20) year transportation master plan?
