HomeMy WebLinkAbout1992-111-07/07/1992-CANAL IMPORTATION BASIN FUND CONSERVATION TRUST FUND NATURAL AREA OPEN SPACE PURCHASE LAND SOUKUP ST RESOLUTION 92-111 OF THE COUNCIL OF THE CITY OF FORT COLLINS AUTHORIZING THE CITY MANAGER TO PURCHASE A 6.6-ACRE SITE FOR STORMWATER, NATURAL AREA, AND OPEN SPACE PURPOSES WHEREAS, the Goals and Objectives of the Comprehensive Plan of the City of Fort Collins support the acquisition of land for public open space to meet citizen's needs for recreation, scenic, and natural areas; and WHEREAS, the City Council adopted the Master Drainageway Plan for the Canal Importation Project; and WHEREAS, the City Council appropriated funds in the 1992 budget for acquisition of natural open space and implementation of the Canal Importation Master Drainageway Plan; and WHEREAS, the 6.6 acre site known as "The Bridges" has the potential to meet multiple City objectives, including stormwater management, conservation of natural areas, public open space and possible future trail expansion; and WHEREAS, $27,000 of the funds for this purchase are available in the Conservation Trust Fund and $3,000 of the funds are in the Canal Importation Basin Fund, and these amounts are budgeted and appropriated and may be used for this acquisition; and WHEREAS, the owner, Brian T. Soukup, is willing to convey the 6.6 acre "The Bridges" site to the City of Fort Collins for a total cost of $30,000. NOW, THEREFORE, BE IT RESOLVED BY THE COUNCIL OF THE CITY OF FORT COLLINS that the City Manager be, and hereby is, authorized to enter into an agreement with Brian T. Soukup for the purchase of a 6.6 acre site, which is described on Exhibit "A" attached hereto and incorporated herein by this reference, for an amount not to exceed Thirty Thousand Dollars ($30,000) . Passed and adopted at a reqular meeting of the Council of the City of Fort Collins held this 7tn day of July, A.D. 1992. D. a Plat of record with the Clerk and Recorder of the said Larimer County, being all that portion of the said Plat lying southerly of the north line of the New Mercer Canal as shown on the said Plat, more particularly described as follows; Considering the north line of the said northwest one quarter of Section 22 as bearing North 89 degrees 51 minutes 45 seconds West (as shown on the said Plat) and with all bearings contained herein relative thereto; Commencing at the north one quarter corner of the said Section 22 , THENCE along the said north line, North 89 degrees 51 minutes 45 seconds West for a distance of 160. 16 feet; THENCE leaving the said north line, South 08 degrees 57 minutes 10 seconds West for a distance of 484 .81 feet to the boundary of the said Plat and to the TRUE POINT OF BEGINNING of this description; THENCE along the said boundary the following five (5) courses and distances, (1) South 58 degrees 00 minutes 00 seconds East for a distance of 41. 5a feet; (2) THENCE South 35 degrees 25 minutes 40 seconds West for a distance of 151. 66 feet; (3) THENCE South 01 degrees 45 minutes 00 seconds East for a distance of 705. 00 feet; (4) THENCE North 89 degrees 58 minutes 06 seconds West for a distance of 380. 00 feet; (5) THENCE North 00 degrees 43 minutes 36 seconds West for a distance of 704 .97 feet (platted as 704 .96 feet) to the said north line of the New Mercer Canal as shown on the said Plat; THENCE along the said north line of the New Mercer Canal the following four (4) courses and distances, (1) South 80 degrees 54 minutes 00 seconds East for a distance of 114 .36 feet (platted as 114 . 31 feet) ; (2) THENCE North 77 degrees 12 minutes 00 seconds East for a distance of 64. 11 feet; (3) THENCE North 58 degrees 48 minutes 00 seconds East for a distance of 77. 11 feet; (4) THENCE North 42 degrees 28 minutes 00 seconds East for a distance of 55. 05 feet to the said boundary of the Plat; THENCE along the said boundary the following -five (5) courses and distances, (1) North 34 degrees 40 minutes 00 seconds East for a distance of 136.40 feet; (2) THENCE North 08 degrees 57 minutes 10 seconds East for a distance of 111. 35 feet; (3) THENCE South 83 degrees 00 minutes 00 seconds East for a distance of 30. 00 feet; EXHIBIT "A" PAGE 2 of 2 (4) THENCE South 08 degrees 57 minutes 10 seconds West for a distance of 128. 59 feet; (5) THENCE South 58 degree's 00 minutes 00 seconds East for a distance of 43 . 47 feet to the point of beginning. The above described tract contains 6. 629 acres or 288752 square feet and is subject to all easements and rights of ways now existing or of record. I hereby state that the above description was prepared by me and is true and correct to the best of my professional knowledge, belief and opinion.
