OF THE COUNCIL OF THE CITY OF FORT COLLINS
DESIGNATING THE COLORADO AIRPORT OPERATORS
ASSOCIATION AS THE CITY'S AGENT FOR THE PREPARATION
OF PART I OF THE NATIONAL POLLUTANT
DISCHARGE ELIMINATION PROCESS STORMWATER
GROUP APPLICATION; REQUESTING ASSISTANCE
OF THE DEPARTMENT OF TRANSPORTATION AERONAUTICS
DIVISION; AND AUTHORIZING THE COLORADO
AERONAUTICAL BOARD TO ISSUE FUNDS ON BEHALF OF
THE FORT COLLINS-LOVELAND MUNICIPAL AIRPORT
TO THE COLORADO AIRPORT OPERATORS ASSOCIATION.
WHEREAS, the Colorado General Assembly declared in Section 43-10-101 ,
C.R.S. , that:
. . . there exists a need to promote the safe operation and
accessibility of general aviation in this state; that improvement
of general aviation transportation facilities will promote
diversified economic development across the state; and that
accessibility to airport facilities for residents of this state is
crucial in the event of medical or other type of emergency. . . . ;
and
WHEREAS, Section 43-10-103(2) , C.R.S. , requires the Aeronautics Division
in the Colorado Department of Transportation ("the Division") to provide support
to the Colorado Aeronautical Board ("the CAB") in fulfilling its duties, such
as administering State grant programs; and
WHEREAS, Section 43-10-103(5) , C.R.S. , states that:
The Division is authorized to assist only those airports which
request assistance by means of a resolution passed by the governing
board of the airport and forwarded to the Division; and
WHEREAS, the Colorado Airport Operations Association ("CAOA") , acting on
behalf of 70 public-use airports in the State, has obtained professional
consulting services for the preparation of Part I of the National Pollutant
Discharge Elimination Process ("the NPDES") group application and will incur
costs for these services in an amount not to exceed Twelve Thousand Five Hundred
Dollars ($12,500.00) ; and
WHEREAS, this group application is required in order that each of the 70
public-use airports in the State regulated by the federal Clean Water Act of
1987 and the Colorado Department of Health obtain the mandatory general industry
permit for discharging stormwater runoff into waters of the United States and
the State of Colorado; and
WHEREAS, CAOA has requested a grant in the amount of Twelve Thousand Five
Hundred Dollars ($12,500.00) from the CAB on behalf of the 70 airports included
in the NPDES stormwater group application; and
WHEREAS, to comply with the provisions of Section 43-10-101 , C.R.S. , et
seq. , the governing body of each of the 70 airports in the State must designate
CAOA as its agent for preparing Part I of the NPDES stormwater group application
and for requesting a grant from the CAB; and
WHEREAS, prior to providing CAOA, as the agent for a specific airport, a
grant for preparation of Part I of the NPDES group application, the CAB must
receive local authorization to provide such grant funds to CAOA; and
WHEREAS, if the CAB grants One Hundred Eighty Dollars ($180.00) to CAOA
on behalf of each of the 70 airports in the State that adopt the necessary
resolution, CAOA will have sufficient funds to pay for the NPDES application
preparation services.
NOW, THEREFORE, BE IT RESOLVED BY THE COUNCIL OF THE CITY OF FORT COLLINS
on behalf of the Fort Collins-Loveland Municipal Airport ("the Airport") , the
following:
Section 1 . That pursuant to Section 43-10-103(5) , the Division is hereby
requested to provide assistance to CAOA in obtaining a grant for the CAB to
cover the costs of professional consulting services for the preparation of Part
I of a NPDES group application.
Section 2. That CAOA is hereby designated as the City's agent with
authority to only make the allocations necessary to obtain and pay for all
matters associated with the preparation of Part I of the NPDES group application
and to receive grant funds from the Division and the CAB in connection
therewith.
Section 3. That the City, acting on behalf of the Airport, hereby
ratifies and resubmits CAOA's request for a grant of Twelve Thousand Five
Hundred Dollars ($12,500.00) (One Hundred Eighty Dollars [$180.00] for each
airport) from the CAB for the purpose of paying for the preparation of the NPDES
group application.
Section 4. That the City does hereby grant the CAB authority to provide
funds on its behalf to CAOA in an amount not to exceed One Hundred Eighty
Dollars ($180.00) per airport.
Section 5. That the CAOA shall use such grant funds only for the purpose
of covering actual professional consulting fees associated with the preparation
of Part I of the NPDES group application and shall not assess or collect any
administrative fees for this service and shall return any unused portion of the
grant funds to the Division.
Passed and adopted at a regular meeting of the Council of the City of Fort
Collins held this 19th day of November, A . 1991 .
