OF THE COUNCIL OF THE CITY OF FORT COLLINS
AUTHORIZING THE CITY TO TAKE SUCH ACTION AS REQUIRED
TO AMEND ITS SMALL RECLAMATION PROJECT LOAN FOR
JOE WRIGHT RESERVOIR
WHEREAS, on the 21st day of April , 1978, the City of Fort Collins
("City" ) did enter into a loan repayment contract with the United States of
America with regard to a certain loan received from the United States by
the City for assistance in defraying a portion of the costs and expenses
incurred in the construction of Joe Wright Reservoir; and
WHEREAS, as said contract is now written, interest is charged on
lands irrigated in excess of 160 acres per individual , and 320 acres for
husband and wife; and
WHEREAS, pursuant to the Reclamation Reform Act of 1982, Title II,
Pub.L. 97-293 the contract may be amended to conform it to the Reclamation
Reform Act of 1982 acreage threshold at which interest will be charged for
water delivery, which threshold is 960 acres for "qualified recipients" and
320 acres for "limited recipients"; and
WHEREAS, pursuant to 43 CFR 426.21 (B) no other provision of the loan
contract shall be altered, modified or amended without the consent of the
City; and
WHEREAS, it is hereby determined by the Council of the City of Fort
Collins that it is in the best interests of the City that the aforesaid
contract be amended to incorporate acreage thresholds as established by the
Reclamation Reform Act of 1982.
NOW, THEREFORE, BE IT RESOLVED BY THE COUNCIL OF THE CITY OF FORT
COLLINS that the City Manager be, and he hereby is, authorized to take such
actions as are required to amend the City' s aforesaid loan repayment
contract with the United States of America for the purpose of incorporating
therein the acreage thresholds as are established pursuant to the Reclama-
tion Reform Act of 1982,Title II, Pub.L. 97-293 provided that no other
provision of loan contract shall be altered, modified or amended without
the additional consent of the City.
Passed and adopted at a regular meeting of the Council of the City
of Fort Collins held this 2nd day of April , A.D. 1985.
