AUTHORIZING THE CITY MANAGER TO ENTER INTO
AN INTERIM OPERATING SERVICES AGREEMENT
WITH THE FORT COLLINS MUNICIPAL RAILWAY SOCIETY
WHEREAS, on March 17, 1981 , the City of Fort Collins ("City" ) and the
Fort Collins Municipal Railway Society ("Society" ) entered into a Construc-
tion Agreement to allow the construction of a trolley line along the median
of West Mountain Avenue for the purpose of allowing the operation of the
trolley car which has been restored by the Society; and
WHEREAS, paragraph 9 of that Construction Agreement provides that the
City will enter into an operating agreement with the Society to provide the
opportunity for the Society to operate the trolley car along West Mountain
Avenue; and
WHEREAS, it is in the interest of the citizens of Fort Collins that
the City enter in an Interim Operating Services Agreement at this time,
which Agreement expires on December 31, 1986 with provision for a two-year
extension upon agreement of the parties and an annual review as a mechanism
to modify the Agreement; and
WHEREAS, the Interim Operating Services Agreement provides the neces-
sary requirements for the safe operation of the trolley and also describes
the responsibilities of the parties and establishes rider fees, hours of
operation and operator training procedures; and
WHEREAS, citizen input has been solicited and that input considered
when drafting the Interim Operating Services Agreement; and
WHEREAS, by entering into an Interim Operating Services Agreement, the
Society and the City are furthering their mutual desire to provide an
opportunity for the residents of the City of Fort Collins and visitors to
observe, experience and appreciate an example of living history.
NOW, THEREFORE, BE IT RESOLVED BY THE COUNCIL OF THE CITY OF FORT
COLLINS that the City Manager be, and he hereby is, authorized to enter
into an Interim Operating Services Agreement as modified with the Fort
Collins Municipal Railway Society which shall expire on December 31, 1986
with provision for a two-year extension upon agreement of the parties.
Passed and adopted at a regular meeting of the City Council held this
2nd day of April, A.D. 1985.
