OF THE COUNCIL OF THE CITY OF FORT COLLINS
AUTHORIZING THE CITY MANAGER TO ENTER INTO
A CONSTRUCTION AGREEMENT - ADDENDUM WITH THE
FORT COLLINS MUNICIPAL RAILWAY SOCIETY
WHEREAS, on March 17, 1981, the City of Fort Collins ("City" ) and the
Fort Collins Municipal Railway Society ("Society" ) entered into a Construc-
tion Agreement to allow the construction of a trolley line along the median
of West Mountain Avenue for the purpose of allowing the operation of the
trolley car which has been restored by the Society; and
WHEREAS, the City Council met on January 29, 1985 and determined that
the Society would be allowed to continue its performance under the original
Construction Agreement so that performance is completed not later than
August 31, 1986; and
WHEREAS, a Construction Agreement - Addendum has been drafted which
further defines the obligations of the Society in regard to construction
Phases IV, V & VI as set out in Exhibit A to the Construction Agreement;
and
WHEREAS, this Addendum strengthens the Construction Agreement to allow
closer supervision of the trolley project so that the public right-of-way
is protected; and
WHEREAS, it is in the best interests of the citizens of the City of
Fort Collins that this Construction Agreement - Addendum be executed by the
City.
NOW, THEREFORE, BE IT RESOLVED BY THE COUNCIL OF THE CITY OF FORT
COLLINS that the City Manager be, and he hereby is, authorized to enter
into a Construction Agreement - Addendum as modified with the Fort Collins
Municipal Railway Society which shall be effective until August 31, 1986
unless sooner terminated by the parties.
Passed and adopted at a regular meeting of the Council of the City of
Fort Collins held this 2nd day of April , A. D. 1985.
