HomeMy WebLinkAbout1985-083-07/02/1985-AMENDING THE URBAN GROWTH AREA RESOLUTION 85-83 OF THE COUNCIL OF THE CITY OF FORT COLLINS AMENDING THE URBAN GROWTH AREA WHEREAS, the City has received a request to amend the Urban Growth Area boundary to include 357 acres located south of Harmony Road and east of Lemay Avenue, set forth in more particular below; and WHEREAS, on April 29, 1985, the Planning and Zoning Board recommended approval of said request with the condition that the underlying FA-1 zoning would remain in place until the property is annexed to the City of Fort Collins ; and WHEREAS, this amendment will facilitate construction of a sewer trunk line within the revised Urban Growth Area in the most feasible location and will allow property owners in the area to benefit from the line 's service ; and WHEREAS, the South Fort Collins Sanitation District has agreed to have the City serve all properties north of the revised Urban Growth Area boundary; and WHEREAS, pursuant to the Urban Growth Area Agreement entered into between the City of Fort Collins and Larimer County on April 29, 1980, both the City Council and the Commissioners of Larimer County must approve said amendment ; and t WHEREAS, the City Council hereby finds and determines that said amendment is in the best interest of the community as a whole. NOW, THEREFORE, BE IT RESOLVED BY THE COUNCIL OF THE CITY OF FORT COLLINS that the Urban Growth Area be, and it hereby is, amended to include 345 acres of land set out more particularly as follows, to wit: Gerald and Elizabeth Ann Dusbabek A tract of land situate in the Southeast 1/4 of Section 6, T.6N., R.68W. of the 6th P.M., County of Larimer, State of Colorado, and being more particularly described as commencing at the intersection of the East line of said Section 6, and the centerline of a drain ditch running through the Northeast 1/4 of the Southeast 1/4 of said Section 6, which point is 282 feet, more or less, North of the Southeast corner of the Northeast 1/4 of the Southeast 1/4 of said Section 6, thence North to the East quarter corner of said Section 6, thence West 1721 feet, more or less, to East line of right-of-way of Union Pacific Railroad Company , thence Southwesterly along East line of said right-of-way to the center of said drain ditch, at a point which is approximately 1962 feet West and 610 feet North of Southeast corner of Northeast 1/4 of Southeast 1/4 of said Section 6, thence Southeasterly in a straight line along the center of said drain ditch to the point of beginning. ALSO, H.H. Investment Company, a Colorado general partnership The North 1/2 of the Southwest 1/4 of Section 5, T.6N., R.68W., of the 6th P.M., County of Larimer, State of Colorado. ALSO, Lyal Nelson The South 1/2 of the Southeast 1/4 of Section 6, T.6N., R.68W. of the 6th P.M., lying east of the Union Pacific Railroad right-of- way, and commence at the Southeast corner of the Northeast 1/4 of the Southeast 1/4 of said Section 6, thence West 2087 feet to the East line of the right-of-way of the Union Pacific Railroad Company; thence Northeasterly along East line of said railroad right-of-way to a point which is 1962 feet West and 610 feet North of the point of beginning; thence Southeasterly in a straight line to the East line of said Section 6 at a point 282 feet North of the point of beginning; thence South 282 feet to the point of beginning and that part of the Northeast 1/4 of Section 7, T.6N., R.68W. of the 6th P.M., lying North of Mail Creek Ditch and East of the Union Pacific Railroad right-of-way. ALSO, Ronald C. & Paula A. Ruff The North 1/2 of the Southeast 1/4 and the South 1/2 of the Southeast 1/4 lying North of the Spring Canyon Waste Water Ditch, except the East 259 feet thereof, of Section 5, T.6N., R.68W. of the 6th P.M., County of Larimer, State of Colorado.
