OF THE COUNCIL OF THE CITY OF FORT COLLINS
SUPPORTING LARIMER COUNTY'S APPLICATION TO THE COLORADO
DEPARTMENT OF LOCAL AFFAIRS SEEKING DESIGNATION OF CERTAIN
AREAS WITHIN THE LARIMER COUNTY AS AN ENTERPRISE ZONE
AND APPOINTMENT OF THE COUNTY PLANNING DIRECTOR AS ZONE ADMINISTRATOR
WHEREAS, the City of Fort Collins has adopted goals and strategies to
encourage business development and job creation in the community; and
WHEREAS, the City of Fort Collins supports regional cooperation among
jurisdictions in Larimer County to achieve the community's goals for economic
development; and
WHEREAS, the establishment of an Enterprise Zone in Larimer County would
advance the City's goals for economic development; and
WHEREAS, the City has identified areas within its corporate limits for
inclusion within the Enterprise Zone proposed by Larimer County and has
cooperated with the County Planning Director regarding the identification of
areas which are located within the City's Urban Growth Area boundary for
inclusion into the proposed Enterprise Zone which areas are identified on the map
attached hereto; and
WHEREAS, the Council of the City of Fort Collins has considered and
approved this resolution in reliance on the fact that the Urban and Rural
Enterprise Zone Act ("the Act") does not contain any provision which preempts
local control over police power regulations including, without limitation,
regulations pertaining to land use, the environment, public health and public
safety; and in reliance that no changes in the Act will be made by the General
Assembly which might create any such preemption without the prior meaningful
political collaboration with all enterprise zones in the state.
NOW, THEREFORE, BE IT RESOLVED by the Council of the City of Fort Collins
as follows:
Section 1 . That the City of Fort Collins supports the application of
Larimer County to create an Enterprise Zone in Larimer County.
Section 2. That the City supports the appointment of the Larimer County
Planning Director as Zone Administrator for the proposed zone and supports the
establishment of the Larimer County Overall Economic Development Planning
Committee as the agency to facilitate public input and inter-jurisdictional
coordination for zone administration and the planning process.
Section 3. That the areas identified on Exhibit "A, " which is attached
hereto and incorporated herein by this reference, are hereby approved by the
Council for inclusion within the proposed Enterprise Zone, provided that approval
of said areas shall not preempt, in the specific context of enterprise zones in
the state, the authority of the City of Fort Collins with respect to police and
emergency powers, planning and land use, or any other regulation intended to
protect the safety and well -being of the community. This approval is also
conditioned upon agreement by the Department of Local Affairs to consult with the
City of Fort Collins regarding any significant changes or amendments to the
enterprise zone program.
Passed and adopted at a regular meeting of the Council of The City of Fort
Collins held this 2nd day of February, A.D. 1993.
