OF THE COUNCIL OF THE CITY OF FORT COLLINS
AUTHORIZING THE MAYOR TO ENTER INTO A LEASE AGREEMENT
FOR A PORTION OF THE CITY'S TRANSIT FACILITY
AT 6570 PORTNER ROAD WITH CARE-A-VAN, INC.
WHEREAS, the City of Fort Collins, Colorado ("the City") , owns property
located at 6570 Portner Road, Fort Collins, Colorado ("the Property") ; and
WHEREAS, Care-A-Van, Inc. , has occupied a portion of the Property known
as the Southside Service Center Transit Building consisting of seventeen thousand
five hundred fifty (17,550) square feet of shop space and one thousand eight
hundred fifty (1,850) square feet of office space ("the Leased Premises") since
1984 and, under the overall agreement between the parties for the provision of
public paratansit services, has leased the Leased Premises from the City; and
WHEREAS, the City desires to execute a new lease agreement in order to
facilitate the continuing provision of paratransit services to its citizens and
to generate revenue from the Leased Premises; and
WHEREAS, Section 23-114 of the Code of the City requires that any lease
of the City's real property for a term of two years or more be found by the
Council to be in the best interests of the City.
NOW, THEREFORE, BE IT RESOLVED BY THE COUNCIL OF THE CITY OF FORT COLLINS
as follows:
Section 1. That the proposed lease of the Leased Premises is in the best
interests of the City.
Section 2. That the Mayor be, and hereby is, authorized to enter into a
new lease agreement with Care-A-Van, Inc. , for the Leased Premises, which shall
provide for the following:
A guaranteed rental term of two (2) years effective retroactively
as of January 1, 1991, with a base annual rental of Five Thousand
Seven Hundred Sixty Dollars ($5,760.00) per year, with Care-A-Van,
Inc. , obligated to pay fifty percent (50%) of the charges for
electricity, natural gas, water, sewer and storm drainage services
used.

Collins held this 6th day of August, A.D. 199).
