OF THE COUNCIL OF THE CITY OF FORT COLLINS
SETTING FORTH FINDINGS AND DETERMINATIONS REGARDING
THE EAST SIDE/WEST SIDE REZONING PROJECT
WHEREAS, commencing in 1975, the City has focused upon the issues, problems
and opportunities in redevelopment for the core area of the community and the
older residential neighborhoods located adjacent to the central business district
of the City; and
WHEREAS, the City Council has adopted the City's "Goals and Objectives, "
many of which have been designed to establish the basic City land use philosophy
for the aforesaid neighborhoods; and
WHEREAS, in 1979, the City Council adopted a Land Use Policies Plan, which
plan identified the need for more detailed planning policies for the older
sections of the City; and
WHEREAS, as a result of a study of the performance of the Land Development
Guidance System, the City Council adopted several neighborhood plans to better
address the special needs of certain older areas of the City, among which
neighborhood plans were the "East Side Neighborhood Plan," adopted March 1, 1986,
and the "West Side Neighborhood Plan, " adopted July 18, 1989 (the "Neighborhood
Plans") ; and
WHEREAS, the Comprehensive Plan of the City and the Neighborhood Plans
contain recommendations that certain new zoning districts be established in the
affected neighborhoods (the "Neighborhoods") , that certain existing zoning
districts be amended and that certain additions be included in the City Code
regarding site plan design supplemental review; and
WHEREAS, the Neighborhood Plans also recommend that certain lands located
in the Neighborhoods be rezoned and placed into the new and amended zoning
districts and that the zoning map of the City be substantially amended with
respect to the Neighborhood Plans; and
WHEREAS, notwithstanding the recommendations contained in the Neighborhood
Plans, the Council has determined that other elements of the City's Comprehensive
Plan, as well as changed conditions which have been found to exist in the
Neighborhoods, justify and require certain deviations from the Neighborhood
Plans in order to better meet the special needs of the Neighborhoods; and
WHEREAS, the City staff has conducted numerous informational meetings
pertaining to the East Side/West Side Rezoning Project (the "Project") , which
Project includes: (1) the establishment of four new zoning districts to be known
as the N-C-L, N-C-M, N-C-B and C-L Zoning Districts; (2) the amendment of the
R-M, R-H, B-L and B-G Zoning Districts; (3) the addition of a new Subdivision
"G. " to Division 4 of Chapter 29 of the Code pertaining to site plan design
supplemental review; and (4) the amendment of the Zoning District Map to include
certain lands in the Neighborhoods in the various newly established and/or
amended zoning districts which are part of the Project; and
WHEREAS, after due notice was given, the Planning and Zoning Board has held
various hearings regarding the Project and has made its recommendation to the
City Council that the Project be completed upon certain conditions.
NOW, THEREFORE, BE IT RESOLVED BY THE COUNCIL OF THE CITY OF FORT COLLINS
as follows:
Section 1 . That the aforesaid recitals of fact are hereby incorporated
into this Resolution as findings and determinations of the City Council .
Section 2. That in accordance with Sections 29-43 through 29-45 of the
Code of the City, the Council has determined that it is in the best interest of
the City that the Project be approved and adopted, with such conditions as the
Council deems necessary for the protection of the public welfare, as contained
in the Rezoning Ordinance which implements the Project.
Passed and adopted at a regular meeting of the Council of the City of Fort
Collins held this 17th day of September, A.D. 1991.
