OF THE COUNCIL OF THE CITY OF FORT COLLINS
MAKING FINDINGS RELATING TO THE APPEAL OF
DON MYKLES ON BEHALF OF THE GARFIELD STREET
NEIGHBORHOOD COMMITTEE FOR DENIAL OF THE
ST. JOHN'S EVANGELICAL LUTHERAN CHURCH PARKING LOT
WHEREAS, the decision of staff to approve the location and design of a
parking lot in the 300 Block of East Elizabeth and East Garfield Street as
an accessory use to the St. John's Evangelical Lutheran Church located at
305 E. Elizabeth Street was appealed to the Zoning Board of Appeals; and
WHEREAS, the Zoning Board of Appeals met on the 9th day of April ,
1987, considered the appeal on the St. John's parking lot from the
above-mentioned staff decision and voted to uphold the staff decision; and
WHEREAS, the decision of the Zoning Board of Appeals was appealed by
the Garfield Street Neighborhood Committee to the City Council ; and
WHEREAS, the City Council met on the 5th day of May, 1987 considered
the appeal taken by the Garfield Street Neighborhood Committee and voted to
uphold the decision of the Zoning Board of Appeals.
NOW, THEREFORE, BE IT RESOLVED BY THE COUNCIL OF THE CITY OF FORT
COLLINS AS FOLLOWS:
1. The parking spaces to be provided by the proposed lot are not
required to be provided by the Code, and the Code section
referred to by the applicant, 118-81 (D) (1) (c) [1] , is not
applicable to this situation for determining the suitability
of the location of the parking lot.
2. The parking lot complies with the applicable location
sections of the code, 118-81 (D) (1)(c) [2] and 118-81 (A)(3) ,
and therefore the location of the parking across the alley is
an acceptable location.
3. The design of the parking lot complies with the City Code
provisions, specifically with respect to the landscaping and
the Garfield Street curb cut, and said curb cut will
facilitate the circulation of traffic to and from the lot.
4. The decision of the Zoning Board of Appeals to uphold staffs
approval of the parking lot for the St. John's evangelical
Lutheran Church is hereby upheld.
Passed and adopted at a regular meeting of the Council of the City of
Fort Collins held this 19th day of May, A.O. 1987.
