OF THE COUNCIL OF THE CITY OF FORT COLLINS
AUTHORIZING THE PURCHASE OF REAL ESTATE
FOR THE CONSTRUCTION OF SPRING CREEK
MASTER PLAN IMPROVEMENTS SOUTH OF STUART
STREET AND WEST OF COLLEGE AVENUE
WHEREAS, the Council , in 1982, approved the Master Plan for the Spring
Creek Drainage Basin; and
WHEREAS, as a part of said Master Plan, a grass-lined channel from
College Avenue to the Burlington Northern Railroad tracks was recommended;
and
WHEREAS, as a part of the accomplishment of said recommendation, and
to assist in the alleviation of flooding hazards in the area, it is in the
best interests of the City to purchase certain property in the area as
described on Exhibit "A" attached hereto; and
WHEREAS, said property may be purchased for the sum of $215,000.00,
plus $27.58 per day for the period from May 20, 1987, to the date of
closing (to cover the cost of taxes, insurance, maintenance and interest) ;
and
WHEREAS, funds have been appropriated in the 1987 Capital Improvement
Budget for Spring Creek, and are presently available for expenditure; and
WHEREAS, the aforesaid purchase price has been determined by the
Council to be fair and reasonable in the circumstances.
NOW, THEREFORE, BE IT RESOLVED BY THE COUNCIL OF THE CITY OF FORT
COLLINS that the City Manager be, and he hereby is, authorized to enter
into a purchase agreement, and to execute such other documents as may be
necessary to accomplish the purchase of that certain property as described
on Exhibit "A" attached hereto, for the purchase price of $215,000.00, plus
$27.58 per day from May 20, 1987, to the date of closing.
Passed and adopted at a regular meeting of the Council of the City of
Fort Collins held this 7th day of July, A.D. 1987.
