HomeMy WebLinkAbout1984-186-12/04/1984-AUTHORIZING THE PURCHASE OF CERTAIN PROPERTIES IN BLOCK 31 6 RESOLUTION 84- 186 OF THE COUNCIL OF THE CITY OF FORT COLLINS AUTHORIZING THE PURCHASE OF CERTAIN PROPERTIES IN BLOCK 31 WHEREAS, the City of Fort Collins and Larimer County have entered into intergovernmental agreements dated February 3, 1982 and November 20, 1984, wherein the parties agree to jointly acquire certain properties located in Block 31 of the City of Fort Collins; and WHEREAS, certain properties in Block 31 have become available for acquisition, the owners thereof having agreed to sell said properties to the City and County; and WHEREAS, the Council has heretofore authorized the City Manager to enter into contracts to purchase said property; and WHEREAS, said authorization was based upon a commitment received from the County whereby the County agreed to participate in the cost of pur- chasing said property; and WHEREAS, the Council has determined that the execution of the agree- ments, setting forth the terms of such acquisition is in the best interests of the City. NOVI, THEREFORE, BE IT RESOLVED BY THE COUNCIL OF THE CITY OF FORT COLLINS that the City Manager be, and he hereby is, authorized to execute the agreements and that the Mayor be, and he hereby is , authorized to accept the agreements purchasing properties legally described as follows: A. All of Lots 1, 2, 3, 4, and 5 in Block 31 , in the City of Fort Collins, Colorado, and commonly known as 200 West Mountain Avenue, Fort Collins , Colorado for the price of $775,000. B. A tract of land situate in a part of Lots 40 and 41 , Block 31, City of Fort Collins, Colorado, which is more particularly described as beginning at the Northwest corner of said Lot 40, and thence run East 50. .00 feet to the Northeast corner of said Lot 41 ; thence South 40.47 feet along the East line of said Lot 41, thence West 3.20 feet, thence South 0.33 feet; thence West 46.80 feet to a point on the West line of said Lot 40; thence North 40.80 feet to the point of beginning County of Larimer, Satate of Colorado. TOGETHER WITH. An easement for an eave or roof overhang not to exceed 24" in width, said 24" to be south of an immediately adjoining the west 17'6" of the south line of above described premises; pro- vided, however, no portion or part of said eave or roof overhang shall be less than 7 1/2 ' above ground level . SLBJECT TO THE FOLLOWING: A. Easement for foot traffic purposes granted to Charles W. West by instrument recorded November 16, 1972, in Book 1529 at Page 907. Also known and numbered as 112 - 114 South Howes Street, Fort Collins, Colorado for the price of $115,000. C. All of Lots 44, 45, 46, and 47 in Block 31, City of Fort Collins, County of Larimer, State of Colorado for the price of $575,000. for an aggregate purchase price not to exceed one million four hundred sixty-five thousand dollars ($1 ,465,000) plus customary closing costs with the City and County each to acquire an undivided one-half interest in said properties. Passed and adopted at a regular meeting of the Council of the City of Fort Collins held this 4th day of December, 1984. Mayor ATTEST: City Clerk -2-
