OF THE COUNCIL OF THE CITY OF FORT COLLINS
AUTHORIZING THE CITY MANAGER TO ENTER INTO
AN AGREEMENT TO PURCHASE THE ROGERS PROPERTY
TO BE DEVELOPED AS A NEIGHBORHOOD PARK
WHEREAS, the Council of the City of Fort Collins supports the enhance-
ment of the quality of life of the citizens of the City of Fort Collins;
and
WHEREAS, the City Council has determined that the establishment of a
neighborhood park on West Mulberry approximately one-half mile west of Taft
Hill Road would serve to enhance the quality of life of City residents; and
WHEREAS, there is available for such purpose an 8. 6 acre site at said
location known as 2515 West Mulberry; and
WHEREAS, the owners of the property (known as the "Rogers Property")
are willing to convey such land to the City for a total price of One
Hundred Twenty Thousand Dollars ($120 ,000. 00) ; and
WHEREAS, funds for the aforesaid purchase are available and budgeted
in the Parkland Fund, Land Acquisition Account; and
WHEREAS, it has been determined by the City Council that said purchase
is in the best interest of the citizens of the City of Fort Collins.
NOW, THEREFORE, BE IT RESOLVED BY THE COUNCIL OF THE CITY OF FORT
COLLINS that the City Manager be, and he hereby is, authorized to enter
into an agreement for the purchase by the City of an 8. 6 acre site located
at 2515 West Mulberry, said site to be purchased for a total of One Hundred
Twenty Thousand Dollars ($120 ,000.00) to be paid as follows:
Ten Dollars ($10.00) previously paid to the owners of the proper-
ty; Fifty Thousand Dollars ($50,000. 00) to be paid in cash or
certified funds at the time of closing (December 15 , 1984) ; the
balance of Sixty-Nine Thousand Nine Hundred Ninety Dollars
($69,990. 00) to be paid in cash or certified funds on January 31 ,
1985; said payments to be made to the vested owners of said
site, which owners shall convey said property to the City in
fee simple absolute, and free and clear of all liens and encum-
brances.
Passed and adopted at a regular meeting of the City Council held this
20th day of November, 1984.
