MAKING FINDINGS CONCERNING AN APPEAL OF A
ZONING BOARD OF APPEALS DECISION
WHEREAS, on February 9, 1984, the Zoning Board of Appeals denied by a
5-0 vote a variance requested by petitioner Joseph Ostrum to allow the
operation of a sandwich board advertising business (Appeal #1494) ; and
WHEREAS, pursuant to Section 3A-4 of the Code of the City of Fort
Collins, a written notice was filed with the City Clerk, appealing the
decision of the Zoning Board of Appeals concerning the variance request;
and
WHEREAS, on February 21 , 1984, the Council of the City of Fort Collins
heard said appeal ; and
WHEREAS, the Council desires to make certain findings concerning said
appeal .
NOW, THEREFORE, BE IT RESOLVED BY THE COUNCIL OF THE CITY OF FORT
COLLINS that petitioner' s request for a variance is denied and a temporary
revocable permit is hereby granted to petitioner Joseph Ostrum for a
nine-month period beginning February 22, 1984, to allow the operation of a
sandwich board advertising business, subject to the following conditions:
1 . Sandwich board carriers are to be attired in turn-of-the-
century costumes.
2. Sandwich sign boards shall contain two (2) 27 in. by 24 in.
signs lettered in an antique style.
3. Each sandwich board carrier shall walk a course through the
downtown Fort Collins area as indicated on the downtown map
included in the petitioner' s submittal documents.
4. Advertising periods shall be from 10:00 a.m. to 2:00 p.m.
every day, and summer season hours may include a 4:00 p.m. to
8:00 p.m. time period.
5. No more than three sandwich board carriers shall be on the
sidewalks at any one time.
Passed and adopted at a regular meeting of the Council of the City of
Fort Collins held this 20th day of M A.D. 1984.
