HomeMy WebLinkAbout1984-033-02/21/1984-BEING A RESOLUTION REFERRING A SALES AND USE TAX ORDINANCE TO THE QUALIFIED ELECTORS OF THE CITY RESOLUTION 84-33 OF THE COUNCIL OF THE CITY OF FORT COLLINS BEING A RESOLUTION REFERRING A SALES AND USE TAX ORDINANCE TO THE QUALIFIED ELECTORS OF THE CITY WHEREAS, under Section 8, Article XVII of the Charter of the City of Fort Collins, the Council of the City of Fort Collins has the power to refer a proposed ordinance to a vote of the people at a special election called therefor; and WHEREAS, the City Council has reviewed a proposed Ordinance No. 30, 1984, which ordinance increases the sales and use tax on all items except food within the City of Fort Collins; and WHEREAS, in the considered opinion of the City Council said ordinance should be herewith referred to a vote of the people of the City of Fort Collins in an election on May 1, 1984. NOW, THEREFORE, BE IT RESOLVED BY THE COUNCIL OF THE CITY OF FORT COLLINS: Section 1. That there is hereby submitted to the qualified voters of the City of Fort Collins at a special election on May 1, 1984, the question of whether or not the following proposed ordinance should be adopted: ORDINANCE NO. 30, 1984 OF THE COUNCIL OF THE CITY OF FORT COLLINS PROVIDING FOR THE IMPOSITION OF AN ADDITIONAL TWENTY-FIVE HUNDREDTHS PERCENT ( .25%) RETAIL SALES AND USE TAX TO BE EFFECTIVE JULY 1, 1984 WHEREAS, a committee composed of citizens and members of the Council , known as Project RECAP, have considered future needs for capital improve- ments in the community; and WHEREAS, the Project RECAP committee has identified certain projects (totalling approximately $6,652,000) as necessary to the welfare of the community in the next five years; and WHEREAS , the projected revenues of the City are insufficient to construct said capital improvements; and WHEREAS, Council deems it necessary to the welfare of the City to construct said capital improvements; and 1 WHEREAS, heretofore, the City of Fort Collins did enact a two and twenty-five hundredths percent (2.25%) comprehensive sales and use tax which enactment is codified in Chapter 104 of the Code of the City of Fort Collins; and WHEREAS, it appears to the Council of the /City of Fort Collins that an additional twenty-five hundredths percent ( .25%) retail sales and use tax will be necessaryto provide e financing g to the City for projected capital requirements; and WHEREAS, the Council of the City of Fort Collins wishes to impose a retail sales and use tax in the amount of twenty-five hundredths percent ( .25%) excluding taxation of food items , said twenty-five hundredths percent ( .25%) to be in addition to the sales and use tax presently imposed by §104-23B of the Code of the City of Fort Collins or any other change thereto. NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY OF FORT COLLINS as follows: Section 1. The present City sales and use taxes presently described and imposed in Chapter 104 of the Code of the City of Fort Collins shall be increased by an amount of twenty-five hundredths percent ( .25%) on all items except food items as currently defined by C.R.S. , §39-26-102 (4.5) , which tax shall be effective on July 1, 1984 to continue until June 30, 1989, at which time such tax shall cease. Section 2. The revenue raised which is attributable to the portion of the twenty-five hundredths percent ( .25%) sales and use tax collected pursuant to this Ordinance shall be used for the following categories of projects: a. Streets - the projects in this category are those which improve traffic safety and provide for increased capacity of major streets and intersections. Such projects include: 1. Street Projects a. Mason-Howes from Cherry to College b. Timberline from Prospect to Summitview (ROW) c. South College Medians from Creger to Harmony d. Railroad Crossing Signals e. Horsetooth Railroad Crossing west of Timberline 2. Intersection Improvements a. Taft Hill and Laporte b. Taft Hill and Horsetooth c. Lincoln and Mountain -2- b. Facilities and equipment - these projects will improve re- sponse time and efficiency of police, fire, and ambulance; increase internal space for children' s library use; and replace outdated bathhouse facility. Such projects include: 1. Computer Aided Dispatch 2. Library Remodel 3. New Concession/Bathhouse for Outdoor Pool c. Parks and Recreation - these projects will repair and improve streets and parking areas at City Park and Spring Creek Park. d. Open Space and Trails - these projects will provide funding toward completion of the Recreation Trail system west of Taft Hill Road (Foothills) , if necessary for completion; acquisition of portions of open space, greenbelt, and river pond lands; and trail crossing improvements at Spring Creek and College. Section 3. The Council of the City of Fort Collins shall authorize the expenditure of sales and use tax revenues obtained by this Ordinance for any project identified in this Ordinance." Section 2. That Ordinance No. 30, 1984 of the Council of the City of Fort Collins is hereby submitted to the qualified electors of the City of Fort Collins at the Special Election to be held in the several precincts of the City on Tuesday, May 1, 1984, in substantially the following form: PROPOSED ORDINANCE ORDINANCE NO. 30, 1984 OF THE COUNCIL OF THE CITY OF FORT COLLINS, INCREASING THE SALES AND USE TAX BY TWENTY-FIVE HUNDREDTHS PERCENT ( .25%) ON ALL ITEMS EXCEPT FOOD, SUCH TAX TO BEGIN ON JULY 1, 1984 AND CONTINUE TO JUNE 30, 1989 AT WHICH TIME THE TAX SHALL CEASE. THE PURPOSE OF SUCH TAX SHALL BE TO RAISE REVENUES TO ACQUIRE AND COMPLETE CAPITAL PROJECTS IN THE FOLLOWING CATEGORIES: 1 .
