HomeMy WebLinkAbout1984-004-01/03/1984-AUTHORIZING THE ACQUISITION BY EMINENT DOMAIN PROCEEDINGS OF CERTAIN LANDS IN THE CITY RESOLUTION 84- 4 OF THE COUNCIL OF THE CITY OF FORT COLLINS AUTHORIZING THE ACQUISITION BY EMINENT DOMAIN PROCEEDINGS OF CERTAIN LANDS IN THE CITY WHEREAS, the City of Fort ColTins desires to acquire an easement and right-of-way over certain lands hereinafter described for the purpose of installing utility lines and related facilities; and WHEREAS, the City has attempted to negotiate the acquisition of such right-of-way with the owners of the lands, but has been unsuccessful in such negotiations and it appears it will be necessary to acquire such right-of-way through proceedings in eminent domain. NOW, THEREFORE, BE IT RESOLVED BY THE COUNCIL OF THE CITY OF FORT COLLINS: Section 1. The City Council hereby finds and determines that it is necessary that the City of Fort Collins acquire an easement and right-of- way over and across certain lands more particularly described as follows: A strip of land 30 feet in width being 15 feet on each side of the centerline described as follows over a portion of the Southeast 1/4 of the Southwest 1/4 of Section 2, Township 7 North, Range 69 West of the 6th Principal Meridian, Beginning at a point on the West line of the Southeast 1/4 of the Southwest 1/4 of said Section 2 from which the Northwest corner of said Southeast 1/4 of the Southwest 1/4 bears N 00023' 15" E 316.93 feet; thence S 89°31'31" E along a line which is 15 feet North of and parallel with the North line of the South 1/2 of the North 1/2 of the Southeast 1/4 of the Southwest 1/4 of said Section 2 a distance of 1323.81 feet to point of terminus on the East line of said Southeast 1/4 of the Southwest 1/4, Larimer County, Colorado. The limits of 15 feet on each side are to be extended to and terminated upon said West line of the Southeast 1/4 of the Southwest 1/4 and the East line of the Southeast 1/4 of the Southwest 1/4. Also a 50 foot wide temporary construc- tion easement being 35 feet North and 15 feet South of the above described centerline. to be used for utility and all related purposes. V Section 2. The City Council hereby finds and determines that it is not possible to acquire such right-of-way and easement by negotiation with the owners of the land and, therefore, authorizes the City Attorney and the other proper officials of the City to acquire such easement and right-of- way for the City by eminent domain proceedings.
