HomeMy WebLinkAbout1994-027-02/15/1994-ANNEXATION FINDINGS SPRING CREEK FARMS 4TH RESOLUTION 94-27 Oh THE COUNCIL OF THE CITY OF FORT ,j LLINS FINDING SUBSTANTIAL COMPLIANCE AND INITIATING ANNEXATION PROCEEDINGS FOR THE SPRING CREEK FARMS 4TH ANNEXATION WHEREAS, a written petition, together with four (4) prints of an annexation map,_ was heretofore filed with the City Clerk requesting_ the annexation of certain property to be known as the Spring Creek Farms 4th Annexation; and WHEREAS, the Council of the City of Fort Collins desires to initiate annexation proceedings in accordance with law. NOW, THEREFORE, BE IT RESOLVED BY THE COUNCIL OF THE CITY OF FORT COLLINS a-�' fall_ows-:_ Section 1. That the Council of the City of Fort Collins hereby accepts the annexation petition for the Spring Creek 4th Annexation, more particularly described as situate in the County of Larimer, State of Colorado, to wit: A TRACT OF LAND SITUATE IN THE EAST HALF OF SECTION 32 AND THE WEST HALF OF SECTION 33, TOWNSHIP 7 NORTH, RANGE 68 WEST OF THE 6TH P.M. , LARIMER COUNTY, COLORADO, WHICH CONSIDERING THE EAST LINE OF THE SOUTHEAST QUARTER OF SAID SECTION 32 AS BEARING S 00°05'42" E AND WITH ALL BEARINGS CONTAINED HEREIN RELATIVE THERETO, IS CONTAINED WITHIN THE BOUNDARY LINES WHICH BEGIN AT THE CENTER QUARTER CORNER OF SAID SECTION 32, THE TRUE POINT OF BEGINNING, AND RUNS THENCE N 00°06'08" W 960.01 FEET; THENCE S 89°09'42" E 2312.06 FEET; THENCE N 00°07'29" W 233.20 FEET; THENCE N 89°52'31" E 364.77 FEET; THENCE S 00°07'06" E 1177.04 FEET; THENCE S 00°05'42" E 350.56 FEET; THENCE S 89043'44" W 30.00 FEET; THENCE S 00°05'42" E 1997.91 FEET; THENCE N 89°43'15" W 2646.51 FEET; THENCE N 00°06'08" W 2352.58 FEET TO THE POINT OF BEGINNING, EXCLUDING FROM THIS ANNEXATION THAT PARCEL LOCATED IN THE SOUTHEAST QUARTER OF SAID SECTION 32 CONTAINED WITHIN THE BOUNDARY LINES WHICH BEGIN AT THE EAST QUARTER CORNER OF SAID SECTION 32 AND RUNS THENCE N 89°37'32" W 30.00 FEET TO THE TRUE POINT OF BEGINNING; THENCE S 00°05'42" E 175.00 FEET; THENCE N 89037132" W 995.69 FEET; THENCE N 00°05'42" W 175.00 FEET; THENCE S 89037'32" E 995.69 FEET TO THE POINT OF BEGINNING. CONTAINING 199.3470 ACRES. Section 2. That the Council hereby finds and determines that the annexation petition and accompanying map are in substantial compliance with the Municipal Annexation Act. Section 3. That the Notice attached hereto be adopted as a part of this Resolution. Said Notice establishes the date, time and place when a public hearing will be held regarding the passage of an annexation ordinance pertaining to the above described property. The City Clerk is directed to publish a copy of this Resolution and said Notice as provided in the Municipal Annexation Act. Passed and adopted at a regular meeting of the Council of the Cit of Fort Collins held this 15th day of February, A.D. 19 . f� or ATTEST: w a City Clerk NOTICE TO ALL PERSONS INTERESTED: PLEASE TAKE NOTICE that the City Council of the City of Fort Collins has adopted a Resolution initiating annexation proceedings for-the Spring-Creeks Farm 4th Annexation, said Annexation being more particularly described in said Resolution, a copy of which precedes this Notice. That, on April 5, 1994, at the hour of 6:30 p.m. , or as soon thereafter as the matter may come on for hearing in the Council Chambers in the City Hall , 300 Laporte Avenue, Fort Collins, Colorado, the Fort Collins City Council will hold a public hearing upon the annexation petition for the purpose of finding and determining whether the property proposed to be annexed meets the applicable requirements of Colorado law and is considered eligible for annexation. At such hearing, any persons may appear and present such evidence as they may desire. The City of Fort Collins will make reasonable accommodations for access to City services, programs and activities and will make special communication arrangements for persons with disabilities.
